Administrative Rulings and Arbitration
Section 1: Administrative Rulings
The Commanding Officer has, at his/her discretion and without the need for a hearing,
the option to punish a member for improper conduct IF ALL OF THE FOLLOWING CONDITIONS
EXIST:
1. The member will not be suspended for a period of more than 90 days,
2. The member will not be demoted more than one grade or rank,
3. The member is on trial in a public courtroom, for a violent arrest, pending the outcome
of the trial regardless of the amount of time, and/or
4. A conviction or guilty plea for a violent criminal offense as found by a public courtroom
of competent jurisdiction.
The Commanding Officer may not make more than one administrative ruling against a
member for the same incident/issue. If more than one member was involved in the incident/
issue, the Commanding Officer may make one administrative ruling against each member
involved.
Section 2: Arbitration
Any member, who faces a disciplinary hearing, has the right to ask for arbitration
instead of a hearing. The member has the right to request the Regional Coordinator be present
at arbitration. If an Arbitrator is agreed upon by both the member and the Commanding
Officer, the ruling of the Arbitrator will be full and final. The Arbitrator will have the authority to
invoke the following punitive measures: reduction in rank (1 or more grades), loss of promotion
points, and suspension of membership.
Article XI
Miscellaneous Information
Section 1: Disbanding
In the event that the USS Niagara is disbanded, all monies, property, and other
materials belonging to the USS Niagara will be donated to Region 7. Should Region 7 refuse a
donation, another Chapter within STARFLEET will be selected by majority vote. In the event
another chapter within STARFLEET cannot be selected, any other organization can be chosen as
long as they’re registered under some section of 501(c) of the Internal Revenue Code.
