Section 4: Board Members
The Commanding Officer shall act as the chairperson of the hearing board. Senior
Officers shall act as board members, if the member requests a full board. If the member doesn't
request a full board, the Commanding Officer shall make the sole final decision.
Section 5: Authority of the Hearing Board
The Hearing Board has the authority to use punitive measures against a member, if the
board rules against him/her. These measures include suspension or termination of USS Niagara
membership, reduction in rank or any other reasonable course of action.
Section 6: Appeals
Any member has the right to appeal the decision of the Hearing Board to the Regional
Coordinator (RC) first, then to the Commander, STARFLEET. The member must inform the
Commanding Officer of their request for an appeal before contacting the RC.
Section 7: Notifications
The Commanding Officer must advise the Senior Officers and the Regional Coordinator
when a disciplinary hearing is scheduled for a member no less than 30 days prior to the start of
a hearing. The Commanding Officer must also advise the Senior Officers and Regional
Coordinator with the details of the date, time, and location of the hearing.
Section 8: Member Rights
The accused crew member shall have the right to present evidence and/or witnesses on
his or her own behalf at the hearing.
Section 8: Closed Sessions
All hearings shall be considered 'closed session', meaning that the hearing is not open to
the general membership. However, Senior Officers and the Regional Coordinator must not be
denied access to personally witness the hearing. The member has the right to have any
person(s) of their choice attend the hearing.
