Your employment status and benefit eligibility depend upon your employment classifications . All Team Members in all classifications described below are subject to our employment-at-will policy described earlier in this handbook .
Your position is classified as either nonexempt or exempt from state and federal wage and hour laws . Nonexempt Team Members are entitled to overtime pay and other benefits under the wage and hour laws , whereas exempt Team Members are excluded from specific provisions of the wage and hour laws , and don ’ t receive overtime pay . Nonexempt Team Members are usually paid on an hourly basis , while exempt Team Members are usually paid on a salaried basis . We determine whether your position is nonexempt or exempt based on the requirements of state and federal law .
In addition to the above categories , you belong to one or more of the following employment categories :
• Regular Full Time Team Members are those who are not in a temporary category and who are regularly scheduled to work our full-time schedule of at least 35 hours per week throughout the calendar year . Generally , regular full time Team Members are eligible for our entire benefit package , subject to the terms , conditions , and limitations of each benefit program .
• Regular Part Time Team Members are those who are not assigned to a temporary category and who are regularly scheduled to work less than 35 hours per week . Regular part time Team Members may be eligible for some benefits sponsored by us , subject to the terms , conditions , and limitations of each benefit program . Part time Team Members may request to work more than their regularly scheduled workweek on a temporary basis ( such as during the summer or during our holiday season ). However , part-time Team Members are limited to work as follows :
− Team Members typically scheduled to work 30 or less hours a week year-round may request to work more during busy seasons . This does not give the Team Member Full- Time status during those periods .
− Team Members who are typically scheduled to work less than 30 hours per week may not work more than 30 hours per week more than 12 weeks a year . Assignment of the additional hours is in the manager ’ s sole discretion and additional hours are not guaranteed . We reserve the right to limit the number of additional hours at any time . Working additional hours is allowed only on a temporary basis and this does not change a Team Member ’ s status for benefits .
