LIABILITY PROTECTION FOR HEALTH CARE PROVIDERS
Governor Tom Wolf signed an executive order to afford health care practitioners protection against liability for good faith actions taken in response to the call to supplement the health care provider workforce during the COVID-19 pandemic . However , it is limited in scope to providers who are treating patients for COVID-19 .
PDA is working with other stakeholders to lobby the Administration in support of another executive order ; one that would better protect health care providers , including dentists , from liability for any harm arising from abandonment due to the declaration of a national or state emergency that prevented the provider from rendering health care services to patients . It would also provide some protection for providers from the delivery or withholding of health care during the declared emergency due to insufficient resources caused by the disaster that rendered the health care provider unable to provide the level or manner of care required prior to the emergency .
PDA is also lobbying state lawmakers in support of legislation that would provide these protections . PDA ’ s lobbyist is working with Sen . Michele Brooks and her staff on language for a bill that will soon be introduced in the Senate .
We ask all members to be sure to look at alerts asking them to contact their legislators or other government officials in support of a bill or other PDA-sponsored action on this issue . Your voice can make a difference .
