414.00 RACIAL/BIAS-BASED PROFILING
Subject Stop: An interaction between a peace officer and an individual who is being stopped
for the purposes of an investigation, in which the individual is not under arrest.
Motor Vehicle Stop: An occasion in which a peace officer stops a motor vehicle for an alleged
violation of a law or ordinance.
Asset Forfeiture or Asset Seizure: A form of confiscation of assets authorized by the state. It
typically applies to the alleged proceeds or instruments of crime. This applies, but is not
limited, to terrorist activities, drug related crimes, and other criminal and even civil offenses.
E. Prohibition (Renumbered 07-27-17)
1. Officers are strictly prohibited from engaging in racial/bias-based profiling in driver
contacts, field/pedestrian contacts, and in asset seizure and forfeiture efforts.
2. The prohibition against racial/bias-based profiling does not preclude the use of race,
ethnicity, or other factors in a detention decision by a peace officer.
3. Race, ethnicity, and other factors may be legitimate indicators in such a decision when used
as part of a description of a suspect or witness for whom a peace officer is searching.
