Fully autonomous vehicles are on the horizon in the Mountain State . HB 4787 allows motor vehicles with automated driving systems to operate on West Virginia roadways and highways . HB 4797 helps build the infrastructural foundation for fully autonomous vehicles by requiring the West Virginia Department of Transportation ’ s plan to consider the future charging infrastructure needs in the state .

HB 4787 creates the Fully Autonomous Vehicle Act to allow motor vehicles with automated driving systems , designed to function without a human driver , to operate on West Virginia roadways and highways .
Under the new law , a person may operate a fully autonomous vehicle on West Virginia public roads without a human driver , provided that the Automated Driving System is engaged and the vehicle meets several specific conditions , including the submission of a law enforcement interaction plan prior to the fully autonomous vehicle being operated on the road . The law specifies definitions for several new terms and outlines requirements for insurance coverage of a fully autonomous motor vehicle , as well as their equipment standards and what ’ s required after a crash involving fully autonomous vehicles .
HB 4797 requires the West Virginia Department of Transportation to create a state Electric Vehicle Deployment Plan in order to receive its share of National Electric Vehicle Infrastructure ( NEVI ) Formula Program funds .
The NEVI program provides funding for states to deploy electric vehicle charging infrastructure and establish a network that facilitates data collection , access and reliability .
States must submit electric vehicle infrastructure deployment plans to the Federal Joint Office of Energy and Transportation by August 1 , 2022 , describing how the state intends to use its share of NEVI Formula Program funds consistent with Federal Highway Administration guidance before the state can access these funds . In February , the Biden administration announced that West Virginia would receive $ 6.7 million in NEVI funds for Fiscal Year ( FY ) 2022 and $ 45.6 million through FY 2026 .
