ECONOMIC DEVELOPMENT

Two HBs passed during the 2022 legislative session aim to sustain and increase economic development in West Virginia . HB 4502 , the BUILD WV Act , provides tax incentives to encourage the development of residential housing across the state . HB 4002 , the Certified Sites and Development Readiness Program , is intended to incentivize developers to create more development-ready sites for potential investors . HB 4001 was vetoed by the governor .

HB 4001 creates rules intended to support broadband service expansion in the state . At a minimum , HB 4001 gives service providers and communities greater clarity about the development of critical communications networks . The bipartisan bill recognizes three factors critical to broadband expansion : sharing information essential to expanding broadband service , consumer protection and certification of eligible telecommunications carriers to ensure proper oversight of federal broadband expansion funds .
Through HB 4001 , the state expressed its interest in encouraging broadband service providers to expand and maintain quality telecommunications networks to customers . While the bill was passed by both the House and Senate , it was vetoed by Governor Jim Justice on April 4 , 2022 , because it conflicted with federal law .

HB 4002 creates the Certified Sites and Development Readiness Program under the West Virginia Department of Economic Development , which is intended to incentivize developers to create more development-ready sites in the state . Recent high-profile economic development announcements , like Nucor Corporation ’ s planned $ 2.7 billion steel mill project in Mason County , have shown the importance of having development-ready sites in the state to show to potential investors . The Certified Sites and Development Readiness Program will accept applications from county , municipal or regional government entities such as economic development agencies . HB 4002 also creates two funding mechanisms that would help fund site improvements : a matching grant of up to 50 % and a microgrant program of up to $ 25,000 per site .
Many supporters of the bill believe it to be a vital economic development tool . West Virginia must be able to move at the speed of business if we want to have an opportunity to continue to compete for major projects . HB 4002 will ensure the state has plenty of shovel-ready sites to show investors who are looking to move quickly with their projects .

HB 4502 establishes the BUILD WV Act . This governor ’ s bill is designed to support West Virginia ’ s continued growth and momentum as a place to live , work and visit , thanks to its incredible tourism product , new economic development opportunities and position as an industry leader in remote work .
West Virginia is one of the fastest-growing inbound states , tied for third in the nation . As we welcome new residents and fewer locals are moving , the BUILD WV Act is designed to ensure the state is prepared for this influx and its impacts .
As such , the bill provides tax incentives to encourage the development of residential housing across the state in areas with the most immediate need and long-term potential . The act provides a consumer sales and service tax use exemption against contractors ’ purchases of building materials and construction services for approved projects , among other incentives . This fundamental piece of legislation stands to service an immediate need in many West Virginia communities and provide long-term growth and development statewide now and for years to come .
