Bennington Battle victory helped cut off critical British supply lines and led to the eventual defeat and surrender of Burgoyne ’ s Army at Saratoga , New York .
A few weeks later , under orders from Colonel John Brown , Ebenezer led a pre-dawn commando attack up through the woods and over rocks with 40 men , capturing 880-foot Mount Defiance , which was held by 200 British troops commanding two 18-pounder cannons . By his account , once at the summit , they shouted war hoops , fired , and charged at the mostly-sleeping soldiers with his men scrambling up behind him . When he saw a matchstick lit to fire a cannon he bellowed , “ Kill the gunner !” The terrified enemy troops ran for their lives down the cut path to the base of the mountain , into the arms of Major Benjamin Wait and his company , who captured them as prisoners . After the war , Wait would found the town of Waitsfield .

When he wasn ’ t raising eyebrows on the battlefield , Ebenezer served as a Tinmouth representative to the first Vermont assemblies in 1777 and 1778 , as Vermont declared independence from New York and New Hampshire- and wrote its own Constitution . He also served on the Vermont Council of Safety , a transitional shadow government and security force before Vermont had implemented a public law enforcement and judicial system . Among the actions of the 1777 Republic of Vermont Assembly was a statute forbidding the ownership of adult slaves .
Fort Ticonderoga had been recaptured by the British as the American Patriots were unable to staff a full-time garrison . During one mission in 1777 , Ebenezer ’ s company of rangers surrounded and captured the rear guard of the British Army trying to escape Fort Ticonderoga for refuge in Canada . Among the spoils of the British company that was captured north of Essex , New York were a British officer ’ s slave named Dinah Mattis and her infant daughter , Nancy . Allen conferred with his unit to find a consensus for what he was about to do .
Ebenezer wrote an emancipation statement , thereby freeing the two slaves . The statement said , in part , that it was “ not right in the sight of God ” to own slaves , and that they were “ free to pass anywhere in the United States of America without being molested by any person or persons .” Allen filed the emancipation
