ZONING, from?Page 1 application would be heard on this date, but that shouldn’t have occurred. a public notice wasn’t distributed to the general public, and it appeared to have been a miscommunication between multiple parties. it was an accidental occurrence, and a notice will be posted, individually and publically, when the representatives of the application are ready to move forward. “i had an opportunity to speak with the attorneys of Bellevue Property earlier today. as i indicated at the last meeting, there was going to be notice sent out and when they were going to come back, both in the public and in the paper and both individual property owners within 200 feet. it was my understanding that public notice was accidently sent out for property owners within 200 feet, noticing this meeting on august 22, 2013 that the application would be going forward, which is the Wawa application, but however there wasn’t any public notice. it was accidently sent and the applicant will be sending out individual notices and public notices on the date and time they will be coming back, as such it doesn’t mean they will be coming back to the September meeting,” Malinsky said. the July 25 meeting minutes were unanimously approved by the members of the zoning Board of adjustment. the lone agenda item of the evening was a hardship variance, as the applicants of this proposal were seeking a variance to permit a fourfoot high fence on a corner lot for Block 3401, Lot 1, zone GW-1 at 674 Bellevue ave. the applicants were rocco and Leanna fichetola. the fichetolas were seeking to put a fence around parts of their property on the corner of Liberty Street and Bellevue avenue. “right now, we have a dog and a three-foot fence that is within the zone right now. it is a big area and it is basically unusable right now. Between myself and the neighbor that is on Liberty St., we have a line of about six or seven 80 year-old cedar trees that won’t be coming down, but it completely blocks the whole view when you’re driving down Bellevue [avenue], anyway. the maples in the driveway are blocking as well, and it is basically just to enlarge the backyard since it is kind of small and in the future if we were ever to place a garage at least we will have a larger area to work with,” rocco fichetola said. as mentioned, the cedar trees won’t be coming down and the picket fence will go around the six or seven trees that surround the property. the objective is to confine the dog that the family owns to an area that is bigger. town planner Kevin Dixon addressed the board about the particulars of this application, and stated that in a corner lot the maximum fence height allowed is three feet, but the applicants are proposing
