The Truth Is Simple: Lessons From A $ 22 Million Verdict In Rabun County

BACKGROUND On June 26, 2026, a Rabun County jury returned a verdict of $ 22 million in favor of Carol Tucker and the Estate of David Tucker in a medical malpractice and wrongful death case against Dr. Christopher Ratchford, an emergency room physician, and Dr. Richard Cory, a neuroradiologist and shareholder of Gainesville Radiology Group, LLC.
The case arose from a rear-end collision and Tucker transported to Habersham County Medical Center ' s Emergency Department complaining of neck, back, and chest pain. Dr. Ratchford initially ordered a CT scan but later cancelled the CT and substituted plain X-rays. He discharged Mr. Tucker without spine precautions. Two days later, Dr. Cory reviewed the same X-Ray film and also read it as negative.
Four days after the collision, Mr. Tucker ' s legs gave out in a McDonald ' s parking lot and CT scans at nearby ER revealed two unstable fractures— one cervical, one thoracic— that had produced an epidural hematoma compressing the spinal cord. He was life-flighted to a trauma center, underwent emergency surgery, and was left permanently paraplegic.
Wheelchair-bound and dependent on his wife of 57 years, David Tucker eventually died on July 20, 2024.
We filed suit in 2020, after years of scorched-earth
defense litigation and two rejected policy limits demands. Rather than admit liability defendants offered the jury four alternative theories. We had to attack each one.
LEGAL HURDLES: BIFURCATION AND THE EMERGENCY MEDICAL CARE STANDARD Bifurcation. The defense moved to bifurcate under O. C. G. A. § 51- 12-15, separating liability from damages. Many of us predicted bifurcation would backfire in serious injury cases and it did here. Bifurcation gave us nearly two full weeks to dismantle the defense experts and expose fabricated theories before the defense could pivot to sympathy or mitigation. Bifurcation, intended to suppress verdicts, instead compressed all of the defense ' s credibility problems into the first phase which was then magnified in phase two.
