P rominent recent reports of alleged misconduct events involving jury trials have included allegations of concealment of evidence , material misrepresentations to the court , accusations that trials have been “ rigged ” and even an attempt to bribe a juror by delivering cash to her home . These dramatically unethical and unprofessional allegations are newsworthy because they are , thankfully , relatively rare occurrences . Less rare , and even routine , are the myriad ways interested parties can influence or attempt to influence trial outcomes within the bounds of the law , the codes of ethics and the tenets of professionalism . And litigants frequently take actions in the course of a prosecution that fall into gray areas and test the limits of ethical rules and our professional aspirations as lawyers .
On September 25 , the Atlanta Bar Association CLE Board of Trustees will present a panel discussion where a panel of esteemed Atlanta judges and trial lawyers will examine how the outcome of a case can be influenced to alter the result , both within the bounds of the law and ethical rules , outside of these boundaries and in gray areas . The panelists will also discuss how the tenets of professionalism provide important guardrails to guide the prosecution and defense of a case .
Panelists will include Judge Michael Brown , of the U . S . District Court in the Northern District of Georgia , and Judge Rachel Krause , of the Fulton County Superior Court , plus four defense attorneys , Chris Anulewicz of Bradley Arant Boult Cummings LLP , as well as former Fulton County Assistant District Attorney Lawanda Hodges of The Law Firm of Lawanda Hodges LLC , and former Assistant US Attorneys Tom Bever of Smith Gambrell & Russell LLP and Randy Chartash of Chartash Law , LLC . Moderating the discussion is yours truly of Barnes & Thornburg ’ s Atlanta office . A key contributor , who authored the CLE written materials , is Tony Cochran of Smith Gambrell & Russell LLP , also a former prosecutor and a Fellow of the American College of Trial Lawyers .
The presentation will be held at the offices of King & Spalding from 1:30pm – 4pm and be followed by a cocktail reception .
