• Authorised representative ( Only Representatives ( ORs ): Non-Ukrainian companies must appoint a Ukrainian legal entity as its only representative to handle compliance procedures

• End users : Companies that use chemicals in industrial processes must comply with UA REACH safety assessments and recordkeeping . UA REACH imposes strict penalties on companies that fail to comply with its regulations . Non-compliance can result in administrative fines , restrictions on market access or even criminal sanctions in serious cases . By enforcing these penalties , the ministry reinforces the importance of safety standards and protects both the environment and the public from potential risks .

Comparison with EU REACH

UA REACH is closely aligned with the EU REACH framework , reflecting Ukraine ’ s commitment to harmonising its chemical safety standards with those of the EU . Both frameworks require the appointment of an OR to ensure compliance for companies outside their respective jurisdictions .

While pre-registration is no longer possible under EU REACH , UA REACH requires it for all substances on the Ukrainian market . The registration requirements for both regulations apply to substances manufactured or imported in quantities exceeding 1 tonne / year , with exemptions for specific cases . In addition , polymers remain exempt from registration under both frameworks , although monomers must still be registered .

Both frameworks emphasise data requirements based on the tonnage of chemicals , but UA REACH is expected to provide a simplified registration process for substances already registered under EU REACH , reducing administrative burdens and fees . Both regulations encourage coregistration to promote efficiency and data sharing . R & D exemptions and the submission of Safety Data Sheets

By harmonising chemical safety standards , Ukraine aligns itself with established EU practices , creating a smoother path for Ukrainian companies seeking to trade within the EU . This regulatory alignment strengthens market confidence and enhances Ukraine ’ s attractiveness as a trading partner , benefiting Ukrainian industry and opening avenues for economic growth .

In addition , the adoption of EUaligned safety standards makes Ukraine a more attractive destination for foreign investment . International companies looking to expand into the Ukrainian market can do so with the assurance that safety protocols are aligned with familiar EU regulations , facilitating easier entry and greater market stability .
