Liveaboard compensation case overturned

APPEAL JUDGES IN SCOTLAND HAVE overturned a compensation award made to the family of technical diver Lex Warner , who died after a fall on a Scapa-based dive boat .
The decision signals the end of a protracted case , which centred on the extent of a charter skipper ’ s responsibility for client divers . Mr Warner , 50 , from Sutton Coldfield , had been on board the Jean Elaine liveaboard for a week-long diving trip in 2012 when he fell on deck in full kit and sustained what was later found to be an injury to his liver .
A court session in 2021 heard that the boat skipper , Andy Cuthbertson , asked Mr Warner if he wanted to sit out the dive , off Cape Wrath , but he decided to proceed . During the dive , Mr Warner made an emergency ascent from 80m , during which he fell was keen to see how he could help other BSAC clubs do the same .

Despite resuscitation attempts on board the Jean Elaine , Mr Warner could not be revived . An inquest verdict of accidental death caused by drowning and traumatic liver injury was recorded .
Mr Warner ’ s widow , Debbie , had raised the civil action on behalf of their son , Vincent , who was nine months old at the time of his tried it for myself . I made some mistakes but once I learned a few lessons things really fell into place . So many BSAC clubs could really benefit from this !”

father ’ s death . The Warner family ’ s legal team claimed the Jean Elaine ’ s skipper , Andy Cuthbertson , had not done enough to minimise the risks for divers walking on deck .
However , the case went to appeal and was overturned by Lord Carloway , sitting with Lords Woolham and Pentland . They ruled that Mr Cuthbertson had adequate safety measures in place , and overturned the initial judgement and its £ 290,000 payout .
In a written statement explaining the decision , Lord Carloway noted that the boat had in place a safe route from the seat to the exit point , comprising a non-slip and unobstructed deck , hand rails and a deckhand .
He continued : “ Mr Warner , who was well aware of what was an obvious and inherent risk , chose not to use the provided means . That was a matter for his choice in the context of a leisure pursuit in which he , and not the defenders , was the skilled and experienced person . The defenders did not require to give such a person frequently repeated warnings about a risk of which he was already aware .”
