San Lameer House Rules The San Lameer House Rules is an important statutory document containing rules that each owner/member has to comply with. The Board of Directors is empowered in terms of the Memorandum of Incorporation to make House Rules, but the Company, in general meeting, can itself also make any House Rules that the Board of Directors can make. Please take note that the Board of Directors has now decided to revise and amend the House Rules to bring it in line with the demands and regulations of a modern-day residential community as well as requirements and guidelines received from the Community Schemes Ombud Service. The existing House Rules will be revised and new regularity rules will be added to mostly ensure that the security and safety of the Township and the San Lameer brand name will not be negatively impacted upon. The revised House Rules will include, among others, rules related to the following: Letting of villas (short term holiday letting and long term letting) by registered, legal and approved agencies; Ÿ Commercial, business and other activities from home and or inside the Township in general; Ÿ Installation of water tanks, generators and solar devices; Ÿ Enhancement of security and access control; Ÿ Architectural and building control; Ÿ Intellectual property rights and marketing in the Township. Your cooperation will be appreciated. 1. San Lameer Huisreëls Die San Lameer Huisreëls is 'n belangrike statutêre dokument wat reëls bevat waaraan elke eienaar / lid moet voldoen. Die Raad van Direkteure word ingevolge die Akte van Oprigting bemagtig om Huisreëls op te stel, maar die Maatskappy self kan ook tydens Algemene Vergaderings Huisreëls maak wat die Raad van Direkteure kan maak. Neem asseblief kennis dat die Raad van Direkteure nou besluit het om die Huisreëls te hersien en te wysig om dit in ooreenstemming te bring met die eise en regulasies van 'n moderne landgoedgemeenskap, sowel as die vereistes en riglyne wat ontvang is van die Ombudsdiens vir Gemeenskapsskemas. Die bestaande huisreëls sal hersien word en nuwe reguleringsreëls sal bygevoeg word om meestal te verseker dat die sekuriteit en veiligheid van die Landgoed en die San Lameer-handelsnaam nie negatief beïnvloed sal word nie. Die hersiene Huisreëls sal onder andere reels, wat verband hou met die volgende, insluit: Ÿ Verhuur van huise (korttermyn-verhuur en langtermynverhuring) deur geregistreerde, wettige en goedgekeurde agentskappe; Ÿ Kommersiële, besigheids- en ander bedrywighede vanaf villas en op die Landgoed in die algemeen; Ÿ Installering van watertenks, kragopwekkers en sonkragtoestelle; Ÿ Verbetering van sekuriteit- en toegangsbeheer; Ÿ Argitektuur- en boubeheer; Ÿ Intellektuele eiendomsreg en bemarking op die landgoed. U samewerking sal waardeer word. 2. Application lodged with Ray Nkonyeni Local Municipality (RNM) regarding amendments to the San Lameer Town Planning Scheme San Lameer Master Homeowners Association (HOA) has submitted a three (3) fold application to the RNM Department of Development Planning Services in that the HOA applied for the increase in floor area at specified free-standing Lots from 325m² to 400m², the consideration of consolidation at certain Lots as well as general Scheme amendments. This was subsequent to a Resolution tabled and passed by Members at the Annual General Meeting held in December 2018. In accordance with due process and protocol, the municipality requested clearance letters in reference to outstanding debt for rates and other services from San Lameer owners of properties upon which the application was being sought. This request was made in terms of the relevant provisions of the applicable Planning and Land Use Management Bylaw wherein it states: By Law – Section 52(6) “the municipality may not consider or approve any Planning Application if the applicant is liable for any debt due to the municipality until the applicant has provided proof in writing that such debt has been paid in full”. The HOA has obtained a legal opinion in this regard and the process to possibly convince the RNM to change their decision is ongoing. Meanwhile, due to the cordial and excellent relationship that the HOA shares with the municipality, the HOA and municipality have elected to submit a general plea to San Lameer owners who are in arrears to please settle all outstanding accounts with the Ray Nkonyeni Local Municipality as a matter of urgency in an effort to allow the application, to amend the San Lameer Town Planning Scheme, to be processed forthwith. Aansoek by Ray Nkonyeni Plaaslike Munisipaliteit (RNM) ingedien rakende wysigings aan die San Lameer- dorps beplanningskema San Lameer Huiseienaarsvereniging (HEV) het 'n drie (3) voudige aansoek by die RNM Departement van Ontwikkelings - beplanningsdienste ingedien deurdat die HEV aansoek gedoen het in verband met die verhoging van die vloeroppervlakte by spesifieke vrystaande villas van 325m² tot 400m², konsolideringsmoontlikhede by sekere Lot'e sowel as algemene skema-wysigings. Dit het gevolg op 'n resolusie wat tydens die Algemene Jaarvergadering in Desember 2018 aan lede voorgelê en aanvaar is. In ooreenstemming met die proses en protokol, het die munisipaliteit versoek dat goedkeuringsbriewe met betrekking tot uitstaande skuld vir belasting en ander dienste van San Lameer-eienaars van eiendomme , waarop die aansoek ingedien is, voorgelê word. Hierdie versoek is ingedien ingevolge die toepaslike bepalings van die Verordening vir Beplanning en Grondgebruikbestuur waarin dit staan: Volgens wet - Artikel 52 (6) " die Munisipaliteit hoef geen beplanningsaansoeke te oorweeg of goed te keur as die applikant aanspreeklik is vir enige skuld wat aan die munisipaliteit verskuldig is totdat die applikant skriftelik bewys gelewer het dat sodanige skuld ten volle vereffen is nie". Die HEV het 'n regsmening in hierdie verband ingewin en die proses , om die RNM moontlik te oortuig om hul besluit te verander, duur voort. Vanweë die hartlike en uitstekende verhouding wat die HEV met die munisipaliteit deel, rig die HEV en Munisipaliteit aan alle eienaars van San Lameer 'n versoek , vir die wat agterstallig is , om asseblief alle uitstaande rekeninge by die Ray Nkonyeni Plaaslike Munisipaliteit so gou as moontlik te vereffen. Hierdie word as 'n dringende saak gesien in 'n poging om toe te laat dat die aansoek, om die San Lameer Stadsbeplanningskema te wysig , onmiddellik geprosesseer word.
