Tips BEFORE you Start
Not all building works in residential areas need formal development or construction
approval. These works are classified as ‘exempt development’.
Exemption would be for generally minor works that do not impact on your neighbours’
property or Sunday breakfast. However they can only be undertaken on land that is not
classified as ‘environmentally sensitive’.
You can find out if your project is exempt under planning legislation. If your project meets
the standards then the development can proceed without approval.
For example you don’t need approval to build a barbeque structure or a cabana but you
should really find out if a 5 metre high cabana on the edge of your property fits the
standards for a regular exemption.
If you see stars trying to interpret the legislation, ask Wyong Shire Council’s Building
Surveyors to translate the legislation and provide advice. If you do need approval for a
supersized mega-barbeque, they can provide guidance and assist in the process as your
Certifying Authority.
Just remember that development approval is required before building work commences. If
you do not get approval, not only could your project result in substandard construction, but
also conveyancing issues when the property is being sold as well as Council fines and
demolition orders.
It can be expensive legalising your works after the fact so be prepared and informed.
