  Saint  Olave’s  Law  Society  Journal     DISCRIMINATION  IN  EUROPEAN  LAW;   10TH  CENTURY  AND  NOW   BUMADE  AGBAJE   expressing  their  views  at  school   but  Muslims  cannot  go  anywhere.  The   French  Commission  argued  that  it  was  a   safety  issue  that  they  were  stopping   women  from  being  pressurised  into   doing  something  they  don’t  believe  in  by   the  men  in  their  lives  and  that  women   needed  to  have  their  faces  on  show  for   identification  purposes.  If  a  Muslim   woman’s  child  ran  outside  the  house,   would  it  not  be  a  greater  safety  issue  for   her  to  take  the  time  to  remove  her  veil   before  she  does?  That  extra  time  could   have  terrible  implications  for  the   child.  Firstly  the  French  Commission   only  questioned  one  Muslim  woman  out   of  the  whole  population  and  she  was   required  to  remove  her  veil.  The   evidence  shows  that  many  women  wear   the  veils  as  a  sign  of  devotion  to  their   faith,  and  that  many  of  their  husbands   don’t  like  them  wearing  the  veil  but  they   do  anyway.  Additionally,  if  the  state   really  believed  men  were  the  ones   pressuring  women  into  the  full  facial   veil,  should  they  not  be  the  ones   persecuted  instead  of  the  women?       Secondly  the  state  did  not  follow  the   evidence  they  were  given  by  this   woman,  but  admitted  that  they   breached  the  women's  human   rights;  however,  they  then  proceeded  to   make  a  ruling  just  because  some  citizens   (including  those  in  power)  did  not  like   seeing  women  with  the  full  facial  veil.  In   a  recent  case  in  the  UK  involving  a  21   year  old  from  Hackney  a  judge  refused   to  let  a  Muslim  defendant  wear  a  full-­? length  burqa  in  court.  The  judge  said  it   would  be  possible  for  another  person  to   be  her.  If  she  refused  to  remove  her   burqa  she  could  not  stand  trial.  This   similarly  to  the  French  and  Belgian  case   is  where  the  law  and  politics  ended  up   breaching  these  women’s  rights.  Why   should  a  woman  be  forced  to  go  back  on   such  a  personal  decision  she  made   simply  to  stand  trial?  The  judge  put  the     In  the  10th  century  there  were  many   stems  of  discrimination,  the  most   common  ones  against  w ?Y[??CH0?[?[Y?[?CH0???Y[?CH0??\?BCH0?X??\?YCH0??CH0??Z[??CH0??]?\?CH0??\?CH0??X?]\?BCH0?^BCH0?Y??&]CH0?????CH0?BCH0???X[CH0??Y]?CH0?]CH0?^BCH0?\?BCH0??\?CH0??[CH0??X\?\??CH0?Y?CH0?BCH0???X[?CH0??\?BCH0??\?X?YCH0??CH0??Z[??CH0?BCH0??]?
