According to documents available with this magazine, Mr Bakshi’ s five year tenure expired on February 4, 2014. After this he was given an extension of three months, which got over on May 4 the same year.
From here begins the new Bakshi story of money, men, manipulation and management that left some amazed and anxious while some others bewildered and bowled over. In a routine manner Bakshi should have discontinued coming to the office after his extended tenure came to an end on May 4 as no fresh order was issued from any competent authority for his further extension. Records show no fresh order was issued before May 4 that could enable him to continue on the post. The Human Resources Department of the EPIL also did not react immediately or just before Bakshi’ s extended term was to end. Why it did not take any action is anybody’ s guess.
Practically Bakshi was not the CMD of EPIL after May 4, 2016. But what transpired between the authorities in PMO, DoPT and Ministry of Heavy engineering and Public Enterprises that he continued to hold the post illegally after May 4.
A new twist to the story came five days later on May 9. An irregular approval was given by the Media Advisor of the then Minister of Heavy Industries Praful Patel that recommended Bakshi’ case for another extension to the Appointments Committee of the Cabinet.
It too had many discrepancies ies. The lady media advisor of the Minister was a nonofficial who was not authorised to do so.
Further she had taken this approval from the then minister over phone and not in writing. The approval was given on May 9 whereas it should have been given before May 4 when Bakshi’ s extension was to expire.
This matter was not ratified by the Minister as well meaning thereby his continuing in office for those many days was illegal. Further during this period since Parliamentary elections 2014 were on, the Model Code of Conduct was also in force, so even the minister should not have taken such an important decision, leave alone his media advisor. All these circumstantial developments post May 4 solidly
disclose the game Bakshi played in managing situations in his favour. How much did it cost to Mr Bakshi is altogether a different chapter. Eyebrows have also been raised over the mysterious silence of the officials of the Department of Heavy Industries, PMO and DoPT over break of service of Mr Bakshi from May 4 when he was only acting CMD of EPIL. The Company Secretary of the EPIL who raised the issue was tactically removed from the office and since then panic has gripped other senior officials who do not want to become a victim of Bakshi’ s highhandedness.
Bakshi was appointed as fullfledged CMD during UPA regime even when a probe against him by central investigative agency was going on, insiders say.
