The reminder intends to advise the property owner of the violation , and the period within which the violating condition should be corrected . The extent of the violation typically determines if the violation can be corrected with this first step .
If the first notice is not observed , the Due Process continues with a second notice . The second notice is also sent as a letter from the Village Manager . Members can contact their respective Village Manager if they receive a compliance violation . It is also important to contact the Village Manager if the violation has been addressed .
Hearing If a violation is not corrected in a timely manner or not addressed after receiving the two notices , the homeowner will be issued a notice to have a hearing with the Compliance Committee . At the hearing , the committee is provided information on the violation from the Village Manager , including notices and any communication . At the scheduled hearing , the committee listens to the Member in violation and discusses the best means to move forward to correct the violation .
Fines and / or Revoked Membership Privileges The Compliance Committee acts as a third party when reviewing a violation and may choose to implement monetary penalties , revoke membership privileges , grant further extensions , or dismiss the violation . Appeal After the hearing , the homeowner has the right to appeal the compliance committee ’ s decision to the BoD . The appeal must be submitted in writing to LLA within ten days of receipt of the hearing decision to the Village Manager . The BoD can choose whether or not they would like to hear the appeal .
Attorney and / or Lien Unpaid penalties affiliated with a violation may result in the account being sent to the LLA collection agency . Once with the collection agency , a lawsuit may be filed to obtain a judgment from the court for the fees outstanding , attorney fees , and court costs . If a judgement is ignored , a lien can be placed on the property . Ultimately , if necessary , LLA can being foreclosure proceedings .
WHAT KIND OF VIOLATIONS CAN I RECEIVE ? Any breach of the governing documents are subject to receive a violation . This can include , unkempt yards , failure to maintain structures on the property , using unauthorized vehicles on LLA property , etc .
SHOULD I REACH OUT TO MY VILLAGE MANAGER AFTER RECEIVING A VIOLATION NOTICE ? Yes ! Your Village Manager is the best person to contact after receiving a violation and your primary resource of knowledge regarding your property file at the Association . By speaking to your VM , you can determine a timeline to remedy the violation , you can make them aware that the violation was corrected , you can ask them questions about why you received the violation , etc . Speaking to your VM can help alleviate stress , establish a chain of communication , and assist with closing out the violation before it escalates within the Due Process .
WHAT ACTIONS CAN I TAKE AFTER RECEIVING A VIOLATION NOTICE ? It is best to be proactive . First , reach out to your VM . If the violation has escalated to the hearing stage of the Due Process , request the hearing . The Compliance Committee was formed to review your violation and decide if further action is needed to move forward with remediation ( see “ What is the Due Process ?”). Speaking to your VM and / or attending a hearing are your best options for sharing your thoughts , situation , etc . After the hearing stage , the violation is now out of the LLA staff and committee ’ s hands . It may or may not be reviewed by the BoD if you request an appeal and could reach the attorney ’ s office .
WHEN DO I KNOW THE DECISION FROM THE COMPLIANCE COMMITTEE HEARING ?
Members will be notified of the committee ’ s decision in writing within 15 days of the hearing date . It will include the decision and any penalties , sanctions , etc .
WHAT HAPPENS IF I IGNORE MY VIOLATION ? A violation will continue to progress through the Due Process if it is ignored and unaddressed . At times , violations have been sent to the LLA attorney for legal review . In some cases , judgments from the courts are obtained to retrieve monetary penalties and legal fees . If a violation is ignored , membership rights can be turned off and a lien or judgement can be obtained .
