approved by the parties herein and have been subscribed for the purposes of identification by both the parties. NOW THIS AGREEMENT WITNESSETH AS FOLLOWS: 1. That the Contractor shall erect on the said land a building in conformity with the sanctioned plans, drawings and elevations and complete all the said works with the material of best quality and to the satisfaction of the said Owner complete in all respects. 2. That in consideration of the work to be done by the Contractor, the Owner will pay to the Contractor a lump sum amount of Rs........................... and further .............% on the total cost of construction of the said building, as under: 3. That the Owner shall pay for and bear the actual costs of materials, labour and hire charges of plant and machinery on production of the relevant bills and/or receipts and authorisation by the architect. The payment of such bills shall be made within.................. days of production of each bill. 4. That the Contractor shall complete the said building and make the same habitable in all respects for occupation within............ months from the date hereof failing which the Contractor shall pay to the Owner interest at the rate of ...........% p.a. on the amount already spent or invested by the Owner in relation to the construction of the said building, unless such delay was due to the reason which is beyond the control fo the Contractor. 5. That the Owner shall not be responsible for payment of any cost of material or labour if the work done is not in accordance with the agreed plans, specifications and designs, or the materials used is substandard and workmanship poor. 6. That the Contractor shall be under obligation to carry out any suggestion for additions or alterations in the said building plane by the owner but within the sanctioned plan, if feasible. But the owner shall be liable to pay for such additions or alterations. 7. That the Contractor shall undertake all necessary precaution and safety measures while constructing the building, for the protection of labourers as well as the person and property of neighbours or any third party. 8. That any damage arising from accidents or carelessness of the workmen contracted for or to the materials or equipments therein used or to any third party, shall be borne and effectually made è good by the said Contractor at his own costs and charges and the Owner shall not be responsible † for the same. ´ ñ 9. That the Contractor shall not engage any sub-contractor for the actual construction work but shall £ be at liberty to engage sub-contractors for the supply of men and materials, plant and machinery ù without creating any disturbance. That if the Owner consider that any part of the said construction have been executed in an ªð unsound and improper manner, the said Contractor will cause the same to be removed and £ executed in a proper manner to the satisfaction of the Owner without any extra charges or P expenses whatsoever. ò £ 11.
