It goes on having this ability to think and define policies , but then the performers are external : in practice they are the same units but they are now dependent on the Regional Health Administrations . And this , whether we like it or not , has caused some entropy in this operation ... Thus , this articulation [ with the Prison Services ] – once very fluid and very direct – has become more mediated , it has more layers , so , in practice it means that something was lost regarding the agility of the answers . Basically , SICAD itself works directly with the Prison Services in defining guidelines of action and intervention , but this organizational model that we have today , somehow , hinders , to a certain extent , the close connection and work that we used to have . That is why we are now rethinking these structures , within a working group mediated by the Minister of Health , to evaluate the pros and cons of this model found by the previous Government .
JT : Portugal ’ s policy regarding its drugs legal framework and practice has been internationally recognized by the academic community , by the press , and by international organizations … And it has recently also been at the UN to present the result of these years ...
Has this international recognition meant any national reinforcement of support for the implementation of new measures ?
JG : Well , I think that this international recognition was , and basically has been , a positive reinforcement so that we can continue in the line that was consecrated by that strategy of 1999 , that is to say , an approach based in Health , in the Social area , etc . In the United Nations , at this special session of the General Assembly , last year in April , there was , for example , a very significant figure : the international drug control body [ The International Narcotics Control Board ]. The INCB was initially very critical of the way Portugal had taken – in the early stages of 2001 – 2002 – and a few years later came to recognize that , despite Portugal having decriminalized drug use , the results seem , globally , positive . In 2016 , the President of that international entity made a presentation in which he showed a slide that says , for instance , that Portugal is an example of good practice within the spirit of the United Nations treaties . So , it was a journey that took a few years , but today there is a recognition of the goodness of our option , a recognition that also comes from the UN structures . And this , of course , makes life easier for many other countries that somehow felt inclined to accompany us on this journey , but who were still drawn back by the critics of the UN … Now , such countries are surely much more comfortable in doing so . And this seems to us to be a priceless contribution that Portugal , after all , gave to the world , opening new possibilities for addressing these issues .
JT : ¿ Qué papel desempeña el Servicio de Intervención en Comportamientos Adictivos y Dependencias ( SICAD ) dentro del sistema penitenciario portugués ?
JG : El modelo organizativo de las respuestas , en el Ministerio de Salud portugués , dirigido a este tema es , en la actualidad , diferente de lo que era hace unos años . Teníamos el Instituto de Drogas y Toxicomanías ( IDT ), que tenía la capacidad de pensar y armonizar las políticas con diversos ministerios y luego implementarlas en el campo de la Salud , directamente en el campo a través de unidades locales de intervención que trabajaban estrechamente con las cárceles . Hoy en día , el diseño es diferente : SICAD es una Dirección General , sigue teniendo esta capacidad de pensar y definir políticas , pero entonces los actores son externos : en la práctica son las mismas unidades pero ahora dependen de las Administraciones Regionales de Salud . Y esto , nos guste o no , ha causado cierta entropía en esta operación ... Por lo tanto , esta articulación [ con los Servicios Penitenciarios ] – una vez muy fluida y muy directa – se ha vuelto más mediatizada , tiene más capas ; en la práctica significa que algo se perdió con respecto a la agilidad de las respuestas . Básicamente , el propio SICAD trabaja directamente con los Servicios Penitenciarios en la definición de las pautas de acción e intervención , pero este modelo de organización que tenemos hoy , de alguna manera , dificulta , hasta cierto punto , la estrecha relación y trabajo que solíamos tener . Es por eso que ahora estamos replanteando estas estructuras , dentro de un grupo de trabajo mediado por el Ministro de Salud , para evaluar los pros y contras de este modelo encontrado por el Gobierno anterior .
JT : El marco legal y la práctica de Portugal con respecto a las drogas han sido reconocidos internacionalmente por la comunidad académica , por la prensa y por organizaciones internacionales ... Y recientemente también ha estado en la ONU para presentar el resultado de estos años ... ¿ Este reconocimiento internacional ha significado algún refuerzo a la aplicación de nuevas medidas ? ....................
JG : Pues bien , creo que este reconocimiento internacional fue , y básicamente ha sido , un refuerzo positivo para poder continuar en la línea consagrada por esa estrategia de 1999 , es decir , un enfoque basado en la Salud y en el Área Social . En las Naciones Unidas , en este período extraordinario de sesiones de la Asamblea General , el año pasado , en abril , hubo , por ejemplo , una cifra muy significativa : la Junta Internacional de Fiscalización de Estupefacientes que fuera muy crítica de la forma que Portugal había hallado – en las primeras etapas de 2001- 2002 – llegó unos años más tarde a reconocer que , a pesar de Portugal haber despenalizado el consumo de drogas , los resultados les parecían globalmente positivos – y en 2016 , el Presidente de esa entidad hizo una presentación en la que mostró una diapositiva que dice , por ejemplo , que Portugal es un ejemplo de buenas prácticas dentro del espíritu de los tratados de las Naciones Unidas . Por lo tanto , fue un camino que tardó unos años , pero hoy se reconoce la bondad de nuestra opción , un reconocimiento que también viene de las estructuras de la ONU . Y esto , por supuesto , facilita la vida a muchos otros países que de alguna manera se sintieron inclinados a acompañarnos en este camino , pero que seguían siendo atraídos por los críticos de la ONU ... Ahora , estos países seguramente estarán mucho más cómodos haciéndolo . Y esto nos parece una contribución invaluable que Portugal , después de todo , dio al mundo , abriendo nuevas posibilidades para abordar estas cuestiones .
