and industrial manufacturing zoning districts with either a building or special
use permit. However, there are no regulations requiring coordination with
Seymour Johnson AFB and the DCR.
City of Washington Zoning Ordinance
The zoning ordinance divides the land within the city into 17 base districts.
There are no regulations requiring coordination with Seymour Johnson AFB
and the DCR in the city’s zoning ordinance.
Town of Duck Zoning Ordinance
The Town of Duck amended its zoning ordinance to incorporate regulations
for wind energy facilities in May 2010. Section 156.138 of the ordinance
prohibits commercial wind energy facilities and only allows supplementary
wind energy facilities. Wind turbine structures are allowed in all zoning
districts but are not allowed to exceed five feet above the maximum height
limitation established within each zoning district. With these restrictions in
place, the maximum height of a wind turbine permitted in the Town of Duck
is 57 feet. The ordinance does not require any coordination or
documentation from DCR, Seymour Johnson AFB or the state for approval of
future wind energy facilities.
Town of Kill Devil Hills Wind Energy Systems Ordinance
The Town of Kill Devil Hills adopted a wind energy systems ordinance in 2007
that requires a zoning permit from the town planning board to install a wind
energy system. Towers are restricted to a maximum height of 80 feet. The
ordinance does not require any coordination or documentation from DCR,
Seymour Johnson AFB or the state for approval of future wind energy
facilities.
Town of Nags Head Zoning Ordinance
The zoning ordinance for the Town of Nags Head includes regulations for roof
top wind energy facilities and vertical axis wind energy facilities. A
development permit must be issued before the construction of a wind energy
facility is constructed. The ordinance does not require any coordination or
documentation from DCR, Seymour Johnson AFB or the state for approval of
future wind energy facilities.
Town of Manteo Zoning Ordinance
Section 12‐8.1 establishes regulations for wind energy facilities in the Town
of Manteo Zoning Ordinance. The application to construct a wind energy
facility requires a certification of compliance with applicable local, state, and
federal regulations. There is no required coordination regarding military
compatibility with DCR or Seymour Johnson AFB.
Town of Southern Shores
Section 36‐176 of the Town of Southern Shores Zoning Ordinance establishes
regulations for wind energy facilities. Wind turbine structures are limited to
a maximum height of 45 feet. The ordinance does not require any
coordination or documentation from DCR, Seymour Johnson AFB or the state
for approval of future wind energy facilities.
Findings
None of the communities near the DCR require coordination with
Seymour Johnson AFB and DCR in their zoning ordinances.
Uncoordinated communication can result in reactionary and
potentially costly planning practices.
Town of Kitty Hawk Small Wind Energy Facilities
The Town of Kitty Hawk regulates the construction and operation of small
wind energy facilities under Section 42‐527 of the town’s supplemental
regulations. Small wind energy facilities are permitted as a conditional use in
any zoning district, but must be under 35 feet among other standards.
