ZONING AND PLANNING NEWS:
Over the past couple of months, the Borough of Millvale Council has approved multiple ordinances that update zoning and planning regulations within the Borough. Below is a breakdown of the key ordinances that were passed. Copies of these ordinances can be found on the Borough website.
Ordinance No. 2826 – The Borough created Subdivision and Land Development regulations to help streamline the review process for subdivisions and land development within the Borough and to make the Borough less dependent on County regulations.
Ordinance No. 2831 – This ordinance establishes the purpose and intent of each zoning district within the Borough of Millvale.
Ordinance No. 2832 – This ordinance establishes the creation of a site plan review process for any proposed land development that would not fall under the Borough Subdivision and Land Development regulations.
Ordinance No. 2833 – The parking proposed uses and requirements within the Borough Zoning Code were consolidated into a Parking Table, to help residents and applicants better understand / read the requirements needed for any proposed use. Two additional uses and requirements were added to the Parking Table,“ Multiple Commercial uses with Residential” and“ Multiple Commercial uses.” These two new uses will help better address proposed developments that are a mix of commercial uses and a mix of commercial uses that include residential uses.
Ordinance No. 2834- To help better address the parking issues within the Borough, parking reduction regulations were created. The purpose of the reduction regulations is to recognize the importance of providing adequate off-street parking areas, the need to limit the number of paved parking areas to preserve open space and limit stormwater runoff, and to be able to address unique circumstances associated with land use. A resident or applicant can only use one reduction per parcel. Given that one of the parking reductions allows for a parking study, guidelines were created to help the Planning Commission and the Borough Council in their review of any proposed parking study.
Ordinance No. 2835 – This ordinance allows the establishment of overlay zoning districts in the Borough based on particular community development objectives consistent with the Borough Zoning Code and Comprehensive Plan. Overlay zoning districts are a technique that allows the Borough of Millvale to create zoning regulations to address specific land use issues by creating a special zoning district that is placed over the underlying base zoning district. Overlay regulations can address uses, design, density, and protections to guide and enhance development within a specific area. In the interest of public health, safety, and welfare, the following characteristics shall be evident where overlay zoning is proposed:( a) Overlay zones shall be created through the application of recognized zoning review procedures, public notice and public hearing processes;( b) Purpose and boundaries for each proposed overlay zone shall be identified and mapped;( c) Classification of uses, whether permitted or by special exception, in the overlay shall be administered as outlined in the Pennsylvania Municipalities Planning Code, as amended;( d) Overlay zones shall offer added flexibility within the context of the overall Comprehensive Plan; and( e) Overlay zones shall permit the focusing of supplemental Borough land use regulations in key areas where specific objectives have been identified.
