There has been much confusion regarding the new law, with numerous phone calls to authorities for assistance. We are going to attempt to provide some clarity. Must have ATF license or permit and an operational permit issued by the Township. In order to purchase, possess, and use consumer fireworks, a person must be at least 18 years of age. In addition, a person may not ignite or discharge: 1. 2. 3. •Consumer fireworks or sparkling devices within, or throw fireworks or sparkling devices from, a motor vehicle or building. 4. •Consumer fireworks or sparkling devices into or at a motor vehicle or building or at another person. 5. •Consumer fireworks or sparkling devices while the person is under the influence of alcohol, a controlled substance, or another drug. •Consumer fireworks within 150 feet of an occupied structure*. *Occupied Structure: A structure, vehicle or place adapted for overnight accommodation of persons or for conducting business whether or not a person is actually present. •Consumer fireworks on public or private property without express permission of the owner A person who possesses or uses consumer fireworks in violation of the law may be charged with a Summary Offense and face a monetary fine. They may also be liable to pay for any damages that occur, as well as payment for the response of public safety agencies. To help you determine if you can use consumer fireworks on your property we have published a map indicating prohibited areas (MillcreekTownship.com). If you are in doubt if you can use fireworks in an area it is better to not take the chance.
