CHALLENGE TO
CUSTOMARY PRACTICE
OF MEDICINE DENIED
BY COURT
In the recent court case of Kentucky Board of Chiropractic Examiners
v. Barlow, an appeals court ruled against the chiropractic board.
The June 27 decision defeated a move which may have otherwise
impeded the regular scope of medical practice.
The suit arose when the KBCE claimed the defendants could not
provide expert review of chiropractic services. The board cited a
state statute that limits peer review, but the appeals court felt the
defendant had not done engaged in a peer review. Instead, the
court classified their work as an expert review and testimonial.
The Kentucky Medical Association (KMA) contributed money to the
case via the legal trust fund, which members have the opportunity
to donate to when paying membership dues.
In a “friend-of-the-court” brief filed by the Litigation Center of the
American Medical Association and State Medical Societies, the AMA
stated, “Providing expert opinions and testimony is a facet of the
practice of medicine for many physicians, and it is an important
service to their patients and the community at large. … Blurring
the lines between expert review and peer review would be a disservice both to litigants and to health care professionals. Each
type of review serves different purposes and involves different
processes, procedures and results.”
