BASSAM MOHAMED KHALIL DARWISH EL-TATARI PRACTICE LOCATION: Windsor AREA OF PRACTICE: Family Medicine HEARING INFORMATION: Statement of Uncontested Facts and Plea of No Contest; Joint Submission on Penalty On April 30, 2019, the Discipline Committee found that Dr. El-Tatari committed an act of professional misconduct, in that he has engaged in an act or omis- sion relevant to the practice of medicine that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional. At all material times, Dr. El-Tatari practised at a walk-in clinic and at his own office in Windsor, Ontario. The Committee found that Dr. El-Tatari engaged in a pattern of boundary violations repeated over several years, with eight different women. Often, these events took place in situations where the pa- tient felt particularly vulnerable – when undergoing an intimate examination and clothed only in a gown. He engaged in hugs and told patient that they were his “favourite.” He conducted sensitive examinations without proper explanation, which demonstrated a disregard for his patients. ORDER The Discipline Committee ordered: a five-month sus- pension on Dr. El-Tatari’s certificate of registration; a suspension; a reprimand and terms, conditions and limitations on Dr. El-Tatari’s certificate of registra- tion. The terms, conditions and limitations include not allowing Dr. El-Tatari to engage in any professional encounters of any kind, in person or otherwise, with patients, unless the patient encounter takes place in the presence of a College-approved monitor and that a sign is posted in his examination rooms to that effect. He must also successfully complete the Understanding Boundaries and Managing the Risks Inherent in Doctor-Patient Relationships course; and pay the College $6000 in hearing costs. SOL JULIAN GOLDSTEIN PRACTICE LOCATION: Toronto AREA OF PRACTICE: Psychiatry HEARING INFORMATION: Statement of Uncontested Facts; Plea of No Contest; Joint Submission on Penalty On June 19, 2019 the Discipline Committee found that Dr. Goldstein committed an act of professional misconduct, in that he engaged in an act or omis- sion relevant to the practice of medicine that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, and that he has failed to maintain the standard of practice of the profession. On the basis of information received from the Health Services Branch of the Ontario Ministry of Health and Long-Term Care identifying concerns with Dr. Goldstein’s record-keeping and billing prac- tices, as well as other information, the College com- menced an investigation to obtain a broader view of Dr. Goldstein’s psychiatry practice.
