Other”: Legal Issues in Florida

Same sex marriage is now legal in all states
since June 26, 2015, when the U.S. Supreme Court
ruled in Obergefell v. Hodges that state bans on
same sex marriage are unconstitutional. This means
that, if you are a same sex couple that has been
legally married in any state, you
are entitled to the same legal
rights and benefits as heterosex-
ual couples, both in Florida and in
the United States. This covers
everything from taxes to health
insurance, life insurance and pen-
sion benefits, as well as property
tax exemptions for widows or wid-
owers and any other state or fed-
eral law that previously applied to
traditional marriages. It also
means that, in the event of a
divorce, the same rules apply.
However, if you are not mar-
ried but are living together as
domestic partners or significant
others, regardless of your sexual
orientation, none of the laws for
marriage apply. There is no
“common law marriage” in
