CMS Staffing Compliance with Facility Assessments
• You must meet the minimum staffing standards regardless of your resident ’ s case-mix , as they are the minimum standard of staffing . If the acuity needs of your residents require a higher level of care , as the acuity needs in many facilities will , a higher total , RN and nurse aide staffing level will likely be required .
CMS is proposing the following staggered implementation for the staffing requirements :
• Rural Facilities : The 3.48 total HPRD requirement and 24 / 7 onsite RN requirement must be met 3 years after the publication of the Final Rule on 5 / 10 / 2024 . Non-rural facilities will have 2 years after the publication of the final rule .
• Rural Facilities : The . 55 RN HPRD and 2.45 nurse aide HPRD requirement must be implemented 5 years after the publication of the final rule . Non-rural facilities will have 3 years after the publication of the final rule .
CMS has indicated that these minimum standards will be reevaluated over time , and the expectation is that they will eventually be increased .
