Resumen
El Principio del Interés Superior de la Niñez precepto jurídico que se estable en el primer párrafo del artículo 3 de la Convención sobre los Derechos del Niño de 1989 , ratificada por el Estado Mexicano en 1990 ; sin embargo , no fue sino hasta el año 2011 , en que dicho principio se incorpora al artículo 4 ° de nuestra Constitución Política de México , que en su párrafo noveno establece lo conducente : “ En todas las decisiones y actuaciones del Estado se velará y cumplirá con el principio del interés superior de la niñez , garantizando de manera plena sus derechos ….”
Su eficacia de precepto es mas en un mero discurso político o parte de un silogismo jurídico . Dentro de su desarrollo histórico evolucionando , el derecho de gozar de una protección especial el desarrollarse física , mental , espiritual , social y moralmente en condiciones de libertad y dignidad . Mediante la obligación de regular internamente este principio , e incorporarlo a las diversas leyes de cada país , en México , el máximo Tribunal de Justicia , ha emitido diversos criterios jurisprudenciales en los que se ha pretendido establecer este precepto .

Abstract
The Principle of the Best Interest of Children is a legal precept established in the first paragraph of article 3 of the 1989 Convention on the Rights of the Child , ratified by the Mexican State in 1990 ; However , it was not until 2011 , in which this principle was incorporated into article 4 of our Political Constitution of Mexico , which in its ninth paragraph establishes the following : “ In all decisions and actions of the State , the principle of the best interests of children will be ensured and complied with , fully guaranteeing their rights ….”
Its effectiveness as a precept is more in a mere political discourse or part of a legal syllogism . Within its evolving historical development , the right to enjoy special protection and develop physically , mentally , spiritually , socially and morally in conditions of freedom and dignity . Through the obligation to internally regulate this principle , and incorporate it into the various laws of each country , in Mexico , the highest Court of Justice has issued various jurisprudential criteria in which it has sought to establish this precept .
