UNNAO CASE
Servility of our System in protecting the Interests of Rich,
Powerful and Criminal Politicians!
The horrifying accident met by
the teenager from Unnao in U.P,
who in 2017 became the victim of
sexual assault of rape by the B.J.P
MLA Kuldeep Singh Sengar, battling
for her life in a hospital with her
lawyer, amply exposes the real
nature of system – whose interests
it protects.
This shall not be seen simply
in terms of maintaining of law and
order, but in terms of the class
nature of our system. The law and
order enforcement prescribed in
our system is not intended to
protect common people from
violence of the powers that be but
are intended exclusively to protect
the rich ruling classes, their
powerful agents and the politicians
representing the ruling-classes
from the dissent, protest and ire of
the people against their atrocious
acts and anti-people policies. Our
semi-colonial and semi-feudal
system never enforces law and
order against the rulers, ruling-
classes and the criminal politicians.
That is why the teenager victim
who went to Kuldeep Singh Sengar,
a four-time legislator, presently of
B.J.P, from Bangermaw for job two
years ago was raped followed by a
gang rape. This rape case of Unnao
came to light in April last year when
the victim survivor tried to immolate
herself in front of chief minister Yogi
Adityanath’s residence. She took
this step to draw attention to the
police’s refusal to take action
against Sengar. After the complaint,
she and her family members are
hounded. Her father was arrested
and beaten to death by Senegar’s
brother and his accomplicas in
police custody. The CBI was asked
to investigate both the rape case
as well as the death in police
custody. It filed charge-sheets in
Aug,Sep - 2019
both the cases in July last year but
the trial in neither case has started.
Many days after the charge-sheet
was filed, a key witness in this case
Mohmad Yunus died under
“mysterious circumstances”.
Now it is the collision of the
truck with the vehicle in which the
victim, several members of her
family and her lawyer were
travelling causing a serious
accident. In this ‘accident’ one of
the two aunts of the victim is killed,
who is a crucial witness in the rape
case. The victim is in critical
condition. If she too dies, the
criminal politician will walk free by
defeating the process of justice.
Kuldeep Singh drew his
notoriety from patronising illegal
sand mining and operation of
unlicenced passengers. Sengar
has a network of loyalists in almost
every village in Unnao district.
Though sequestered 157 km from
Unnao and kept in Sitapur jail, he
(Sengar) ‘worked hard’ to ensure
that BJP’s candidate from
Loksabha constituency Sakshi
Majaraj, won. On winning the
parliamentary election Sakshi
Maharaj’s first mission was calling
on Sengar at the jail and publicly
proffering thanks to him. Such has
been his political clout with the
ruling B.J.P. For B.J.P winning is all
that matters but not the character
of the candidate. Senegar belongs
to Rajput caste. Yogi Adityanath as
a politician has leveraged his
influence in eastern UP to nurture
Rajput to undermine the power of
Brahmin gangsters whose word
was law. Thus caste politics too
played to protect Sengar from any
action from the government. It is
said that the events (present day
rape, killings etc) are an outcome
of 40 year long animosity of
Senegar towards the victim’s clan,
which turned violent. The
provocation seems to be a trivial
as a fight over the spoils from
illegal sand-mining or rivalry in a
local body election.
Thus Sengar committed
atrocities with impunity unchecked,
with the wilful connivance of the
state and the system.
After a public-cry over this
atrocious horror, the Supreme
Court came in to the picture late
as a letter from the rape survivor’s
kin seeking help was not put up
before the C.J.I in time. This is not
a mere aberration of the Supreme
Court registry, since it is not the first
time that the registry played hooky.
Our system itself is designed
to allow such lapses (intentional)
to avoid necessary action against
the rich and powerful in such
crimes. The police intended to
maintain law & order are the
subordinates of the rich ruling
classes and the rulers. This makes
them to deferring to the powerful
and the rich and treating the
helpless with contempt.
What has happened in Unnao
is a frequent occurrence in many
parts of the country. Unscrupulous
men of power have always been
indulging in crimes of Senegar
kind. The Patriachial system allows
such crimes to continue with
impunity. The women, particularly
the poor women, cannot expect
justice unless they take the
struggle to the level of changing the
present system. As the Mafioso are
embedded in our political system
there is a need to confront them.
This can only be done by a
people’s movement. Such a power-
ful people’s movement has to be
built-up with such an objective.
