Legislature passes bills affecting HOAs
Of the more than 4,000 bills introduced in the current session of the Oregon State Legislature , several have a direct impact on our com-

munity . Senate Bill 329 passed and was signed by the governor in May . It allows for Homeowners Associations to conduct their meetings electronically . The CCC , along with other HOAs , received permission to conduct our meetings via Zoom at the beginning of the pandemic . This new law codifies the practice into state statute . We gradually phase back to in person meetings as we exit the COVID-19 era .
Another bill that passed and was signed by the governor prohibits HOAs from spraying pesticides on private property . It also prohibits an HOA from requiring a homeowner to spray pesticide on their property . The CCC only sprays environmentally approved pesticides in our common area . We use products that are approved by the EPA and are the same ones used on most school grounds throughout the state .

A bill that did not pass would have included a 14-day notice and waiting period before a city could move funds into the emergency account . This would ’ ve caused challenges with addressing natural disasters like the recent ice storm .
A bill that affected the size and weight of boats that were towing wake boards and skiers on the Willamette also failed to get support in the House . The CCC , although not taking a formal position , certainly is in favor of reasonable protections for our more than one mile of shoreline along the river . We expect this bill to come up again in the next session .
Two bills that the board opposed did not pass . The first would have put severe restrictions on our budget process . The board believed that the bill was not necessary since we have numerous safeguards and transparency as a part of our covenants , conditions , and restrictions and bylaws . We also have procedures in place to amend the bylaws .
During the aftermath of the ice storm , it was critical that our property manager had the flexibility in our reserves to address the damage caused by the fallen trees and limbs . The bill , as introduced , would have put several obstacles including a 14-day notice and waiting period before we could move funds into the emergency account .
Finally , a bill that would have seriously limited our ability to regulate and enforce our architectural guidelines passed the House but failed in the Senate . We opposed the “ one size fits all ” approach and are grateful to the Senators who agreed with our position . The bill lumped all food production together and required HOAs to accept unrestricted chicken raising and beekeeping throughout our neighborhood . Again , our position was very straightforward . If the residents of Charbonneau ( or any HOA ) want to amend the bylaws to approve such activities , it should be left up to them and not the Legislature .
City begins work on Old Farm Road The city of Wilsonville has begun utility work on Old Farm Road , as well as Arbor Glen Court and Arbor Glen Loop . Similar to the work done last year on French Prairie , it is part of the Charbonneau District Improvement Plan . Funding for the replacement of sewer , water and storm drains , as well as street repair , comes from funds that have been collected over the years through our water and sewer bills . The city estimates that the work will continue through the summer and urges residents that have to use those streets to exercise caution , as well as patience .

As the Charbonneau Country Club opens up , I would like to welcome back the groups who use the clubhouse for meetings , card games and other events .

Free document shredding
Windermere Real Estate and CCC are teaming up for this event on July 17 from 10 a . m . to noon . There will be a shredding truck located outside the Windermere building .
This is a free event , however , checks made payable to the Wilsonville Food Bank are gratefully accepted to help Wilsonville families in need .
