Should an office be vacated prior to February 1st of the year of service , the State whose student fills the vacancy shall have been considered to hold the office for the year , and that State may not run another candidate for the same office for the following year .
C . Should a vacancy occur due to a candidate for an office not receiving enough votes , the newly elected officers shall appoint a qualified candidate to fill the position . The vacancy shall be considered a State of Emergency scenario ( Constitution Article V Section 3 . B . 3 ), and the newly elected officers shall have the right to decide to allow students from the State that held the office the prior year to be considered for appointment to the vacant position , provided that no other officer from that State has already been elected . All other qualifications of Constitution Article V , Section 2 may apply .
D . Should a vacancy occur during the NJCL Convention in any office other than President , the office may not be filled and any duties of the office at the NJCL Convention may be assumed by other officers as directed by the President . Should a vacancy occur in the office of Parliamentarian during the NJCL Convention , the Constitutional Advisor may act as chair at meetings specified in Bylaws Article III Section 4 .
