PRAYER
No motion to dismiss the petition shall be allowed
expect on the ground of lack of jurisdiction over the subject
matter or over the parties, provided however, that any other
ground that might warrant a dismissal of the case may be raised
as an affirmative defense in an Answer (Sec. 7, A.M. No. 02-11-
10-Sc). If you fail to file an answer, the court shall not declare
you in default and shall order the public prosecutor to investigate
whether collusion exists between the parties (Sec. 8. A.M. No.
02-11-10-SC).
WHEREFORE, it is most respectfully prayed of his Honorable
Court that Judgement be rendered annulling the said marriage of
Petitioner, ISRAEL CRUZ GORDOLA and Respondent JANIS
LIONGSON GORDOLA, declaring the said marriage to be Null
and void, and ordering the Local Civil Registration of Quezon
City to cancel the said marriage from the book of Marriages and
order said Marriage to be no further legal effect.
Petitioner likewise prays for such other reliefs as the Honorable
Court may deem just and equitable under the premises.
