ORDER
Acting on the Petitioner’s Motion to Issue Summons by
Publication, dated, October 18, 2018, the Court GRANTS the
same for the following reasons:
1.
Based on the Sheriff’s Return, the summons upon
the respondent was returned unserved because the respondent
cannot be located at the given address. Upon verification with
the Barangay officials, respondent’s name does not appear in the
indexes of residents.
2.
Section 15, Rule 14 of the Rules of Court and Section
6 of AM No. 02-11-10-SC provide for such service of summons
by publication.
WHEREFORE, the Branch Clerk of Court is directed to
issue the corresponding summons in this case. Let this Order,
the summons together with the Petition, and its annexes, be
published once a week for two consecutive weeks in a newspaper
of General circulation in the Philippines, as may be chosen by
raffle. In addition, as copy of the summons shall be served on
the respondent at his last known address by registered mail. The
respondent is given a period of thirty (30) days from last issue of
publication within which to register his Answer to the Petition.

PETITION
PETITIONER, through counsel, most respectfully states:
1.
The Petitioner ISRAEL CRUZ GORDOLA, is of
legal age, Filipino citizen, married and residing at blk. 26 lot
27, Hamilton Homes, Bucandala I, Imus City, Cavite; Whereas
respondent JANIS LIONGSON GORDOLA, is likewise of legal
age, Filipino citizen, married and residing at 43-4 Lagan St.,
Puerto Prinsesa City, Palawan, where they may be served with
summons and other court processes;
2.
That on January 24, 1998, Petitioner and respondent
were married in Quezon City, Metro Manila, as shown and
evidenced by their Certificate of Marriage, a Xerox Copy of
which is hereto attached and marked as ANNEX “A” and made
integral part thereof;
3.
That prior to said marriage, petitioner and respondent
were already living without benefit of marriage and were blessed
with three (3) children namely: JAN ETHAN LIONGSON
GORDOLA born on December 17, 1996; AISNE DREW
LIONGSON GORDOLA born on June 15, 1998; JAN IVAN
LIONGSON GORDOLA born on July 04, 2000; a certificate of
Live Birth are hereto attached and marked as ANNEX “B”, “C”
and “D” respectively;
4.
That after said Marriage, Petitioner and respondent
lived together as husband and wife, and it was during this period
when petitioner noticed several manifestations of respondents
psychological incapacity to comply with her essential marital
obligations such as her failure to observe love, loyalty, respect
and responsibility for the Petitioner and their children;
5.
That through the years of their living as husband
and wife, respondent’s psychological incapacity become more
magnified and, in fact, respondent become more irresponsible,
unreasonable and physically violent to the Petitioner and even
her child;
6.
That during the period that Petitioner and respondent
lived together as husband and wife, their marital life was marred
by quarrels, misunderstanding, Physical violence, disharmony
caused by respondents emotional and intellectual immaturity,
irresponsibility, unfounded jealousy, loyalty and respect for
which the Petitioner was deprived of peace of mind, happiness
and tranquillity;
7.
That throughout their married life, respondent refused
to change for good thereby resulting to the failure of their
marriage, more so to the misery and happiness of the petitioner;
8.
That to compound the Problem, injury and pain which
made the life of the Petitioner miserable respondent, sometime
on April 2001 abandoned the Petitioner and their children JAN
ETHAN LIONGSONGORDOLA, AISNE DREW LIONGOSN
GORDOLA, JAN IVAN LIONGSON GORDOLA and thereafter
respondent lived with another man;
9.
That respondents Psychological incapacity was so
grave, serious and incurable, so much so that reconciliation of
the parties are no longer possible;
10. That the above-mentioned facts demonstrate
respondents psychological incapacity to comply with the
essential obligations of marriage, Under Article 36 of the Family
code, such psychological incapacity entities the Petitioner to an
annulment of marriage and for a consequent declaration of the
