People's Power and the Judiciary

On September 15, 2024, the day Mexico commemorates the "Grito de la Independencia" (Cry of Independence),

the addition, amendment, and repeal of various provisions of the Political Constitution of the United Mexican States regarding the Judiciary were published in the Official Gazette of the Federation.

The reform was approved in general and specific terms

by a qualified majority—with 86 votes in favor, 41 against,

and 0 abstentions.

 

The "Judicial Reform" establishes a new composition for the Supreme Court of Justice of the Nation (SCJN) and the creation of the Judicial Disciplinary Tribunal. It also establishes the procedure for the Justices of the SCJN, Magistrates of the Federal Electoral Tribunal and the Disciplinary Tribunal, Circuit Magistrates, and District Judges to be freely, directly, and secretly elected by the citizens in ordinary federal elections. Furthermore, it specifies that the Constitutions and laws of the States

must establish the conditions for the popular election

of Magistrates, Judges, and Judges of the Local Judicial Branches, among other issues.

 

Hugo Aguilar Ortiz, a Mixtec lawyer and Indigenous rights advocate, elected as Chief Justice of the Supreme Court.
