( 8 ) Th e d a m a g e s s p e c i f i e d i n s u b s e c t i o n ( 3 ) s h a l l n o t b e r e - c o v e r a b l e b y
adult children and the damages specified in subsection (4) shall not be recoverable
by parents of an adult child with respect to claims for medical negligence as
defined by s. 766.106(1).

§ 440.16. Compensation for Death
(1) If death results from the accident within 1 year thereafter or follows
c o n t i n u o u s d i s a b i l i t y a n d r e s u l t s f r o m t h e a c c i d e n t w i t h i n 5 y e a r s t h e r e a f t e r, t h e
e m p l o y e r s h a l l p ay :
( a ) W i t h i n 1 4 d ay s a f t e r r e c e i v i n g t h e b i l l , a c t u a l f u n e r a l e x p e n s e s n o t t o
exceed $7,500.
(b) Compensation, in addition to the above, in the following percentages
o f t h e av e r a g e w e e k l y w a g e s t o t h e f o l l o w i n g p e r s o n s e n t i t l e d t h e r e t o o n a c c o u n t o f
dependency upon the deceased, and in the following order of preference, subject
to the limitation provided in subparagraph 2., but such compensation shall be
subject to the limits provided in s. 440.12(2), shall not exceed $150,000, and
m ay b e l e s s t h a n , b u t s h a l l n o t e x c e e d , f o r a l l d e p e n d e n t s o r p e r s o n s e n t i t l e d t o

(c) Death benefits—Death benefits equal to the lesser of $5,000 or the
