In a criminal matter, State’ s Attorney Ryan James Younggren knowingly submitted a video and transcript to a jury containing inadmissible evidence under Rule 404( b) of the North Dakota Rules of Evidence, without giving proper notice of intent to present prior bad act evidence. The North Dakota Supreme Court held that action was prosecutorial misconduct. Younggren stipulated to a reprimand by the Disciplinary Board for violation of N. D. R. Prof. Conduct 3.4, Fairness to Opposing Party and Counsel.
