Late Breaking: Lacey Act Enforcement Delayed Until Oct. 1

The CWPCA is reporting that Implementation of the Lacy Act, which was set to begin on July 1st, has now been delayed to October 1st. In the meantime, CWPCA has submitted a proposal to the US government to allow five different species groups to be applied to wood packaging exports from Canada. The association feels this would simplify matters for the industry. The proposal is currently being reviewed by the US Animal and Plant Health Inspection Service (APHIS).

The Lacey Act is US legislation which aims to prevent the sale of endangered species, including lumber. Unfortunately for our industry, the US government has opted to include HTS code 4415 (assembled pallets, crates, sub assembled crates, cable reels, etc) under the list of inclusions. For Canadian exporters of wood packaging material, this means declaring the genus, species and origin of the wood used to build your products.
