Village Board tables brunch / special event law in Montgomery

The Montgomery Village Board has tabled a vote on a local law allowing a bed and breakfast to extend its public brunch hours until it hears back from the county planning board .
Village Attorney Kevin Dowd explained at the regular village board meeting May 17 that the Orange County Planning Board needs 30 days to review the proposed law before it makes a recommendation , and that the village had only presented the law to the county two weeks prior .
Anna Frumes wants to extend public brunch hours at the Borland House Bed and Breakfast , located across Clinton Street from Village Hall , an extra two hours , or from 8 a . m . to 3 p . m . The proposed law would allow that , and would also regulate how many people can attend parties at the inn at one time . The proposed law handed out at the meeting limited it to 20 , at the village planning board ’ s discretion .

them packing last year , Legoland representatives turned their sights on Orange County , where Neuhaus says they ’ ve received a much warmer response . Several towns have “ rolled out the red carpet ” and even sent letters of support , as Maybrook Mayor Dennis Leahy did back in October .
“ Leahy has been very out front on this with me ,” said Neuhaus . “ When you have the local mayor or supervisor showing support , that goes a long way with Legoland .”
According to the county executive , after the falling out with Haverstraw , Legoland representatives didn ’ t want to be burned again . So he pointed out to them that six separate casino sites were recently supported by communities in Orange County .
“ If they like casinos , they ’ re going to love Legoland ,” said Neuhaus .
One of those sites is in the town of Montgomery , and was suggested as a possibility to Legoland by Leahy . Formerly the proposed site for the Genting resort casino , it is conveniently located near the Stewart International Airport , Interstate 84 and the NYS Thruway in the town of Montgomery .
The village of Maybrook is one of three villages inside the town of Montgomery .
“ There is potential for a family destination which would bring more traffic off the exit and enhance not only the three villages , but enhance the entire town ,” said Mayor Leahy .
The park is projected to create 500 full-time positions and approximately another thousand seasonal , part-time positions .
Legoland executives have been visiting potential sites and negotiating with property owners in Wallkill , Goshen , Chester , Woodbury , New Windsor and Montgomery . Their decision is anticipated in the next couple weeks partly because Legoland is on a self-imposed deadline . They want to open the new facility — their third park in the United States — by 2019 .
The proposed park would mirror their existing parks in the law goes to the village Planning Board . That board meets only on the fourth Wednesday of each month , so Mayor Stephen Brescia suggested calling a special meeting earlier than that so as not to hinder Frumes ’ operations .
In other news , Trustee Walt Lindner announced that the village may remove the pavement from the driveway of the old post office and use donated topsoil and donated posts to help add to the village green and integrate it with the bandstand .
Trustee Mike Hembury said 500 American flags were donated and will be handed out at the start of the Memorial Day Parade on Monday , May 30 , to spectators . According to the village , the parade lines up at 10:30 a . m . on Wallkill Avenue by the Grange Hall , and will proceed for a mile through the village streets , comprising parts of Boyd , Union , Clinton and Bridge streets . Neuhaus said the Legoland executives need to purchase a property and get the project before a planning board as soon as possible so that construction can begin within a year .
“ It ’ s doable , especially if they pick a site that works and the municipality is willing to get it done ,” said Neuhaus .
Montgomery Town Supervisor Mike Hayes admitted that he hasn ’ t pursued the project , but would welcome it . Not having any children of his own , he said he hadn ’ t heard of Legoland before the proposal began circulating . “ I ’ m more than open to talk to them ,” said Hayes . At a recent village board meeting , Leahy expressed disappointment that the town board has not been actively pursuing the project , which he believes would “ enhance economic growth and development in the entire town .”
“ Unfortunately , the Town of Montgomery does not think outside the box so we all suffer as a result ,” Leahy said at the meeting .
Leahy explained that he has been receiving phone calls from residents , asking if Montgomery is still in the running , but hasn ’ t heard anything from the town board .
“ How are you supposed to get things done if you don ’ t make the attempt ?” said Leahy . “ If you don ’ t reach out to people like this , they ’ re never going to come .”
Orange County Executive Steve Neuhaus said at this stage , in terms of showing support for the project , “ everything is done , for the most part .”
Neuhaus said he had the opportunity a few weeks ago to tour the Legoland park in Florida . Forgetting for a moment the economic benefits to the project , he said the park has an educational component that will be a “ great benefit ” to the children in the county .
He said he will make sure that both public and private schools in the county have a relationship with Legoland to utilize the park for educational purposes — not simply for field trips , but also for the interactive components .
“ If they come to Orange County , whether in Montgomery or another town , students from all over the county will benefit from that ,” said Neuhaus .
Police Blotter
TOWN OF CRAWFORD POLICE Cody Doviak , 20 , of Pine Bush , was charged May 9 with Aggravated Unlicensed Operation of a Motor Vehicle . Police said Doviak was stopped on Ulsterville Road for speeding . A check showed a suspended driver ’ s license . He was released to appear in Town Court on June 6 .
Darla Wiley , 41 , of Wallkill , was charged May 10 with Criminal Contempt 2nd . Police said Wiley violated a court order of protection . She was released on return to Town Court later that evening .
James Arvanetes , 53 , of Pine Bush , was charged May 10 with Driving While Intoxicated . Police said Arvanetes was stopped for speeding and was intoxicated . He was arrested and given a breath test that showed his blood alcohol content greater than . 08 %. He was released to appear in Town Court on May 17 .
Jerry Eckert , 33 , of Bloomingburg , was charged May 8 with Aggravated Unlicensed Operation of a Motor Vehicle and suspended registration . Police said Eckert was stopped for speeding on 17K and a check showed a suspended driver ’ s license and vehicle registration . He was released on the Crawford charges to return to Town Court on June 6 .
TOWN OF MONTGOMERY POLICE Aixa I . Napoleon-DeJesus , 25 , was charged May 20 with aggravated unlicensed operation third degree and speeding in a posted zone .
Dennis W . Pennenga was charged May 22 with aggravated harassment in the second degree .
Joseph D . James was charged May 18 with burglary in the third degree , criminal trespass third degree and petit larceny .
Paul A . Colantuono was charged May 16 with criminal mischief 4th degree , preventing assistance .
Harold H . Gagne was charged May 11 with criminal possession of a weapon 4th . Robert P . Henderson was arrested May 9 on a bench warrant . Tina M . Quinlan was charged May 7 with unlicensed dogs and failure to provide rabies vaccination .
Kristina Narkaj was charged May 8 with unlawful possession of marijuana .
STATE POLICE / ORANGE COUNTY CHILD ABUSE UNIT
On May 17 , the Orange County Child Abuse Unit . which is comprised of members from the New York State Police , Village of Goshen Police , City of Port Jervis Police and Orange County Sheriff ’ s Office arrested a 25 year old man for the class D Felony of Assault in the Second Degree and class A Misdemeanor of Endangering the Welfare of a Child .
State Police arrested and charged Alban Rowe of Walden , following a report to the New York State Child Abuse Hotline . The Orange County Child Abuse Unit conducted this investigation in conjunction with the Orange County Department of Social Services - Child Protective Services . Investigators allege that Rowe , who was caring for his 8 month old son on Sunday , May 15th , had caused physical injuries to several areas on his son ’ s body . Upon noticiing the injuries , the child ’ s mother brought her son to the hospital and the hospital staff contacted the Child Abuse Hotline which commenced the investigation . Rowe was arrested at the State Police Montgomery Barracks and arraigned before Walden Village Justice Raynard Osman in the Village of Walden Court . Judge Osman issued an order of protection and remanded Rowe to the Orange County Jail in lieu of $ 1000 cash / $ 2500 secured bond
A criminal charge is merely an allegation that a defendant has committed a violation of the criminal law , and it is not evidence of guilt . All defendants are presumed innocent and entitled to a fair trial , during which it will be the State of New York ’ s burden to prove guilt beyond a reasonable doubt .
