Right to Repair

Jeremy Smith - Senior Group Legal Counsel , Belron ®
In a signicant win for consumer choice and independent auto repair shops , the European Court of Justice ( ECJ ) has taken steps to remove barriers that hindered the " Right to Repair " movement . This movement advocates giving customers the freedom to choose where they have their vehicles serviced , ensuring a competitive aftermarket for automotive repairs .
Three crucial aspects of this movement include :
Physical Accessibility :
Independent repair shops need the ability to access essential components , like glass and sensors , without violating intellectual property rights .
Manufacturer Hurdles :
Ensuring that repairs conducted by independent shops do not aect a customer ' s relationship with the original vehicle manufacturer .
Digital & Data Access :
Access to vehicle information and parts is essential for eective repairs , which requires the right regulatory framework and data access .
On October 5th , the ECJ made a signicant decision by removing anti-competitive obstacles imposed by vehicle manufacturers . This ruling grants independent repair shops access to crucial car data , creating a fairer playing eld in the automotive aftermarket and benetting consumers .
Some aftermarket services , such as recalibrating Advanced Driver Assistance Systems ( ADAS ) after a windscreen replacement , depend on accessing a vehicle ' s data stream . Certain manufacturers have obstructed access and demanded license fees , which increases costs and limits competition .
One key consideration for the ECJ was cybersecurity , and the decision arms that manufacturers can address cybersecurity concerns
without limiting independent repairers access to essential data .
The ECJ ruling is a huge win for the independent aftermarket , not just for vehicle glass repair and replacements , but also other independent providers such as collision repair shops and roadside assistant services . These providers can access vehicle data without unnecessary restrictions , aligning with EU law and benetting consumers seeking aordable and accessible repair options .
