GOVERNMENT AND NON-PROFIT SECTION By : James Porter , Esq .
The Government and Non-Profit Division was pleased to have sponsored a session at the 2017 Mid-Year Meeting in March . The session , Representing Non-Profits and Records Requests , was presented at the request of several division members . The speakers were Beth Novotny and James Porter . We would like to contribute to future CLE sessions and welcome suggestions from members as to topics .
HEALTH LAW SECTION By : Drew Kervick and Elizabeth Wohl , Esqs .
Following up on its successful CLE on physician contracting at last year ’ s VBA Annual Meeting , the health law section is organizing a year-in-review presentation at this Fall ’ s VBA meeting . The session will feature Elizabeth Wohl , general counsel at the Brattleboro Retreat , and Jessica Oski , senior managing associate at the Necrason Group , and will focus on the latest developments in the rapidly developing field of health law . IMMIGRATION LAW SECTION Chair : Sidney Collier , Esq .
The past year has been very active in the immigration field , commencing with the Executive Orders issued in January regarding entry into the US . Section Chair Sidney Collier kept the Section informed through VBA Connect as to the January orders and revised Executive Orders in March . On April 20 , 2017 , the VBA convened an Immigration Workshop CLE with information on how to assist immigrants in need , presented by Sidney Collier , Debbie Volk and Leslie Holman ( with a special appearance by TJ Donovan ). Sidney Collier and Erin Jacobsen presented another immigration workshop at the Solo and Small Firm Conference at Basin Harbor in Maine . The Section expects to continue elevated activity in the next 6 months in anticipation of any potential DACA legislation and other changes we will likely see .
INTELLECTUAL PROPERTY LAW SECTION By : Andrew Manitsky , Esq .
The Intellectual Property Section presented on “ Recent Developments in Intellectual Property Law ” at the VBA Annual Meeting in Lake Morey Resort . The presenters were Section members Mark Chadurjian , Gary Franklin , Andrew Manitsky , Justin McCabe , Gordon Troy , and Thomas Valente . They discussed various topics , including the Defend Trade Secrets Act , indemnification issues , and design patents . The Section will have panel members on the Employment Law “ workplace investigations ” CLE at this year ’ s VBA Annual Meeting .
INTERNATIONAL LAW & PRACTICE SECTION By : Mark Oettinger , Esq .
The VBA ’ s International Law & Practice Section has approximately 50 members , and engages in regular informal member-to-member resource sharing and cross-referral . Section Chair Mark Oettinger published an article in the Winter 2016-2017 issue of the Vermont Bar Journal entitled The Design and Implementation of a World Court of Human Rights . That article chronicles a roughly fouryear effort to design a statute for a supra-national court that would , if implemented , unify the jurisprudence and procedure for the implementation of the growing body of public international human rights law . During the design phase , Mark organized a series of video conferences through which a team of judges , academics and practitioners collaborated to create the present draft . In furtherance of this work , Mark traveled to the 2013 , 2014 and 2015 meetings of the world chief justices , in Lucknow , India . That group has strongly endorsed the effort , which is now focused on getting the “ Treaty of Lucknow ” on the agenda of the Third Committee of the United Nations , the committee with subject matter jurisdiction over matters affecting human rights . Efforts are currently under way to publish a revised version of the article in The Clarion , one of the American Bar Association ’ s leading human rights publications . During the past year , ILP Section members have also actively engaged with the Vermont International Trade Alliance , and the Vermont Council on World Affairs . Members are encouraged to post questions or cases of note to the Section ’ s community on VBA Connect .
JUVENILE LAW SECTION By : Pamela Marsh , Esq .
The Juvenile Law Section had several very poorly attended meetings early in the year . There was some enthusiasm about writing articles for the Vermont Bar Journal . The Section doesn ’ t seem to be fully utilizing the new VBA Connect system . This Section can accomplish more if members are willing to put effort into it .
