WHY YOU, AND WHY THIS?

The South African Council for the Architectural Profession has determined that It is an overriding obligation under the rules that in carrying out professional work, a registered person is expected to act competently and with integrity, and it is therefore expected that a registered person shall refrain from conduct, which would in the opinion of the SACAP be detrimental to the esteem, dignity and/or professionalism of the architectural profession, or would tend to bring the architectural profession into disrepute.

By virtue of the above and taking the Occupational Health and Safety Act with its promulgated Construction Regulations into consideration, it is without doubt that the stipulations made therein, should be considered and adhered to by architects with immediate effect.

IN THE INTEREST OF HEALTH AND SAFETY LEGISLATION IN SOUTH AFRICA, THE FOLLOWING LEGAL FACTORS FOR ARCHITECTS IS OF UTMOST IMPORTANCE.

CONSTRUCTION REGULATION 1: DEFINITIONS

The legislator defines two important words here “design” and “designer”. The designer is an architect or engineer contributing to, or having overall responsibility for a design, and any drawings, calculations, design details and specifications for a building or structure will be seen as a design.

CONSTRUCTION REGULATION 2: THE SCOPE OF THE CONSTRUCTION REGULATIONS AND WHY IT IS APPLICABLE TO DESIGNERS?

These Regulations are applicable to all persons involved in construction work. This includes the client, architect, engineer, contractors or any party that plays a role in the construction, erection, alteration, maintenance, renovation, repair, demolition or dismantling of or addition to a building, structure, bridge, dam, canal, road, railway, runway, sewer or water reticulation system or the moving of earth, clearing of land, the making of excavation, piling, or any similar civil engineering structure or type of work.
