COMPLYING WITH REQUIREMENTS
Our businesses are subject to various rules and regulations at the federal , state , and local government levels . We believe that we are in compliance with these rules and regulations and that we have the appropriate licenses to bid and perform work in the locations in which we operate . We provide employees with necessary training upon hire and during employment to perform required work , and we monitor conformance via our Quality Program .
In FY20 we received the following Notices of Violation :
■ On or about July 2 , 2019 TRC Government Services , LLC received an NOV from North Carolina Department of Environmental Quality (“ NCDEQ ”) concerning UST calibrations of overfill prevention equipment and testing requirements for sumps and spill buckets at a military installation . TRC submitted proof of corrective actions and the NOV was
resolved and removed without any monetary fine / penalty to TRC
■ On or about July 16 , 2019 TRC Solutions , Inc . received an NOV from South Coast Air Quality Management District (“ SCAQMD ”) concerning air monitoring work at Cal Compact Landfill in Carson , CA . The NOV was issued on 6 / 26 / 19 and states the violation allegedly occurred on 12 / 1 / 17 but TRC did not receive any prior notice of this NOV nor was TRC performing any work at the site on that date . The SCAQMD General Counsel ’ s office is expected to review this matter and issue further information to TRC ( and our client ) concerning their classification of the NOV and whether a settlement or hearing will be sought .
■ On July 20 , 2019 an NOV was issued by the NYC DEP to TRC Engineers pertaining to the failure to create and maintain air sampling logs . TRC paid a nominal fine in full and final settlement and in lieu of a formal hearing .
■ On November 26 , 2019 TRC Engineers , Inc . was served with an NOV by NYCDEP concerning an inspector ’ s placement of sampling cassettes and requirement concerning permanently bound notebook pages . The Hearing was adjourned at NYCDEP ’ s request due to COVID-19 to 11 / 13 / 2020 , at which time a stipulated settlement is expected .
■ On or about January 15 , 2020 TRC received an NOV from NYSDOH concerning the use and storage of XRF device that was observed on 10 / 19 / 19 . On 6 / 29 / 2020 NYS DOH advised TRC that it accepted and agreed with TRC ’ s action plan as satisfactory and further advised the noncompliance inspection report is removed without any fine or other penalty .
■ On or about May 6 , 2020 TRC Environmental Corporation received an NOV from Wisconsin Department of Natural Resources (“ DNR ”) concerning TRC ’ s asbestos abatement oversight work of the removal of fireproofing materials from a building located in Appleton , Wisconsin . On 6 / 11 / 2020 TRC transmitted its Commitment Letter , per the DNR ’ s request . No reply has been received to date .
Non-compliance events and near misses are communicated internally to share lessons learned in order to avoid recurrence .
