Civil Litigation (Benefits):
Parents
choose civil litigation by default, not
understanding that they could have used a
collaborative approach to resolve their
divorce case. Most parents who want
their case resolved before a Judge do so
because they believe that civil litigation is
the ONLY way they can resolve the issues
that are in dispute. A trial offers parents
finality and a way to express concerns and complaints about the other parent. Family law
courts are extremely effective in resolving high conflict cases where there is little to no
chance that the parties can resolve their differences amicably.
