Civil Litigation (Benefits): Parents choose civil litigation by default, not understanding that they could have used a collaborative approach to resolve their divorce case. Most parents who want their case resolved before a Judge do so because they believe that civil litigation is the ONLY way they can resolve the issues that are in dispute. A trial offers parents finality and a way to express concerns and complaints about the other parent.
