Dear Dr . Gibson :
The Texas Department of Transportation ( TxDOT ) has submitted an application to the Texas Commission on Environmental Quality ( TCEQ ) for a single Statewide Municipal Separate Storm Sewer System ( MS4 ) Permit . When granted by TCEQ , the TxDOT Statewide MS4 permit will make TxDOT ' s co-permitting with local governments unnecessary ; consequently , once TxDOT ' s statewide permit application is approved by TCEQ , the Fort Worth District of TxDOT will no longer be participating as a co-permittee with the City of Arlington on our existing MS4 permit or on future MS4 permit renewals .
We understand the City of Arlington is set to renew the permit . TxDOT will not be participating in this renewal as a co-permittee . The TxDOT Fort Worth District will continue to comply with the existing MS4 permit requirements in accordance with our Inter-local agreement until TxDOT receives its Statewide Permit from TCEQ .
More specifically , according to the existing co-permitting agreements , the TxDOT Fort Worth District and the City of Arlington agreed to perform or contribute the following :
1 . Wet Weather Monitoring Event ( completed by NCTCOG ) 2 . Floatables Monitoring ( completed by City of Arlington )
3 . Public Education ( completed by City of Arlington )
Once TxDOT ' s statewide permit application is approved by TCEQ , the Fort Worth District will ask for the City of Arlington ’ s cooperation in completing TCEQ Form TCEQ-20031 ( 09 / 01 / 2010 ) Application to Transfer a Wastewater / CAFO Permit to put into effect the transfer of our existing permit , in its entirety , to the City of Arlington , if such permit is still administratively continued .
