Spouses in Injury Cases

Why is my wife on the complaint when I was alone in the car accident ?
In Tennessee , once a married couple has one of them injured due to the negligence of another person , the spouse of the injured party is also considered injured . This surprises many people . Their claim is called a loss of consortium . It is a derivative claim of the personal injury case of the physically injured party .
Tennessee is like many states wherein we recognize a married couple as two parts of a whole . And that means that if one is injured , the other suffers as well . For instance , if one spouse is on the couch hurting , the other spouse must take care of the home , kids , and other services that are not being performed by the injured spouse . But that ' s not all . When one spouse is injured , it interrupts the natural intimacy , companionship , and activities of both together .
I submit to you that this is a very difficult claim to value . In cases where the loss of consortium value is very high , we usually see where one spouse has sacrificed greatly to care hand and foot for the injured spouse . As such , the jury wants to reward that person .

In a few cases , we can business

actually value some of the services that one parent provides . For instance , all the rides that a parent gives children can be priced out as if Uber had done it . The cleaning of the house can be priced out based upon a cleaning service .
However , the intangible lack of intimacy and companionship is very difficult to value . I can tell if my wife is hurting and it hurts me . I would like to take all her pain away when she is suffering . That humanity is one of the things that we seek to show in a personal injury case . That ' s why it ' s important that 12 of your neighbors make the decision as to how to value that based on their life experiences .

In today ' s world of statuses , likes , shares , post , and streaming entertainment they have attributed to a decline of productivity in the workplace . Employees may not see it , but in some ways this can be looked at as a form of time theft if abused .
I was following a story where CNBC reached out to thousands of employers and 28 % of them reported that they have in fact fired persons for non-work related social media usage , and 18 % have even dismissed employees for something they posted on social media .
It ’ s something that employers must quickly address with employees , and would be a good add to any employee handbook . Business Owners ,

It was said that 34 % use it to take a mental break from the job , and 27 % use it to connect with family and friends .
I took to the streets and did my own research , through some of my entrepreneur friends , and I must say even within my own organizations and the statistics are sadly true .
This is becoming a huge problem . The US Chamber of Commerce study shows the average social media user spends approx . one hour of the workday on social media , and millennials 1.8 hours .
This will affect the bottom line profit of any business . Limited social media use in my opinion can and will boost productivity . Social platforms are not alone ; you also have to factor in the streaming world and instant access to shows etc .
In example , 3 weeks ago I walked into my office , and saw " Orange Is The New Black " playing on a screen . Now I love my girls Piper and Taystee , but it has no place in the workplace . I was essentially paying employees to catchup on their shows . This cannot happen .
Be careful of the workarounds ; developers have made called floating browsers , and hacks that will allow movies to play within excel , and other commonly used applications to make it appear that the employee is working . At the click of a button the video vanishes , and leaves work material on the screen . This is not good for business .
Is this the new normal ? How do we fix this ?
