Bishop Cantú’s Statement on Confession Bill SB360
Brothers and Sisters in Christ,
Some of you may be aware that leg-
islation has been proposed in California
(SB360) that reaches deep into the most
intimate elements of our sacramental
practice – the “seal of confession.” This
proposed legislation would require
priests to break that seal. The seal of
confession is inviolable in church law:
a priest who violates the seal of confes-
sion by disclosing anything revealed
during confession is automatically ex-
communicated. This is how seriously
we take the matter. The church wants
penitents to feel that nothing should
come between the honesty of their soul
and the abundant mercy of God.
The Church has provided many mea-
sures to keep our children safe, such as
training for clergy, employees and lay
volunteers; background checks; report-
ing to civil authorities when warranted;
cooperating with state agencies, etc. We
continue to be supportive of measures
that help us to provide a safe environ-
ment for our children. SB360, however,
is not a measure that would be produc-
tive; priests or lay persons who commit
the crime of child abuse do not come to
other priests in confession to reveal their
crimes. There is no evidence that this
has ever occurred. Moreover, this mea-
sure would chip away with government
intrusion at one of the most sacred as-
pects of our Catholic faith and practice,
the inviolable confidentiality between
the penitent and God. Bishop Robert
Barron goes into greater detail on the
troubling nature of this proposed law
in his video, which I recommend all to
watch. Let’s keep protective measures
to those that are actually productive
and do not intrude into the sacramental
structure of our faith.
Even with the proposed amend-
ments, which limit the occasions to
report when abuse is revealed from
another priest or a church staff mem-
ber – even in these limited occasions, I
object to the proposed legislation, as it
does not accomplish what it purports
and sets a dangerous precedent of
government intrusion in the free exer-
cise of our Catholic faith. Priests should
not be faced with the dilemma of being
excommunicated or going to jail!
For over 800 years, leaders through-
out the world have attempted to usurp
this sacred placed for different reasons
but wisdom prevailed to keep the state
and church separate in this area. For
over 200 years, U.S. law has respected
the inviolability of the seal of confes-
sion. Let’s keep it sacred.
As the State Senate has already
passed this bill, I ask that you help
me raise these concerns to the State
Assembly. Please contact your State
Assembly Representative immediately
and tell them to vote “No” on SB360.

Un Mesage del Obispo Oscar Cantú Sobre la Ley SB360
Hermanos y Hermanas en Cristo,
Algunos de ustedes han estado
consientes de la Ley propuesta en
California (SB360) que interfiere con lo
más íntimo del sacramento de la Rec-
onciliación: el “secreto de confesión”.
Esta ley requiere que los sacerdotes
rompan ese secreto. Según la ley de la
iglesia, El secreto de confesión no se
puede divulgar un sacerdote que viola
el secreto de confesión es automática-
mente excomulgado. Así de seria es la
intimidad de la confesión. La iglesia no
quiere que nada se interponga entre el
alma del penitente y la misericordia de
Dios; por eso la importancia del secreto.
La Iglesia ha proporcionado distintas
medidas para proteger y mantener a
nuestros niños seguros, como la ca-
pacitación del clero, los empleados y los
voluntarios laicos; la verificación de an-
tecedentes; el reportar a las autoridades
civiles cuando se requiera; el cooperar
con agencias estatales, y de más medidas.
Seguimos apoyando medidas que nos
ayudan a crear un ambiente seguro para
los niños. Sin embargo, la Ley SB360, no
es una medida que sería eficiente; Los
sacerdotes o laicos que cometen el cri-
men de abuso infantil no acuden a otros
sacerdotes en la confesión. No hay evi-
dencia de que esto haya ocurrido alguna
vez. Más aún, esta medida permitiría la
intrusión del gobierno en uno de los sac-
ramentos más sagrados de nuestra fe, que
es la confianza en el secreto de confesión
entre el penitente y Dios. El obispo Robert
Barron, de Los Ángeles explica con más
detalle en un video lo problemático que
es esta ley. Mantengamos medida de
protección que realmente protegen a los
niños y que no intervengan en la estruc-
tura sacramental de nuestra fe.
Aun con las enmiendas a esta ley
que limitan las ocasiones de reportar
solo cuando se revela el abuso de otro
sacerdote o un miembro del personal de
la iglesia, aun en estas ocasiones limita-
das, yo me opongo a esta ley, ya que no
cumple lo que propone y establece un
precedente peligroso de la intervención
del gobierno en el libre ejercicio de nues-
tra fe. ¡Los sacerdotes no deberían tener
que escoger entre ser excomulgados o ir
a la cárcel!
Durante más de 200 años, la ley de los
Estados Unidos ha respetado el secreto
de confesión. Mantengámoslo sagrado.
Ya que el Senado Estatal en Califor-
nia aprobó esta ley, les pido me ayuden
a plantear estas preocupaciones a la
Asamblea Estatal. Comuníquese in-
mediatamente con su Representante
de la Asamblea Estatal y dígales que
voten “No” a la Ley SB360. También
pueden hacer que su voz sea escuchada

Anh Chị Em thân mến trong Chúa Ki-tô,
Một số trong anh chị em có thể đã
nghe nói đến dự luật SB360 của tiểu bang
California, là dự luật đụng chạm đến yếu
tố riêng tư nhất của việc cử hành bí tích –
đó là “ấn toà giải tội.” Dự luật sẽ đòi buộc
các linh mục phải vi phạm ấn này. Ấn toà
giải tội là điều bất khả xâm phạm theo giáo
luật: linh mục nào vi phạm ấn toà giải tội
qua việc tiết lộ bất cứ điều gì được bộc lộ
khi xưng tội thì tức khắc mang vạ tuyệt
thông. Điều này cho thấy chúng ta coi
trọng vấn đề như thế nào. Giáo hội muốn
các hối nhân cảm thấy rằng không có bất
cứ điều gì có thể cản trở sự thành thật của
linh hồn họ trước lòng thương xót dồi dào
của Thiên Chúa.
Giáo hội đã có nhiều biện pháp để giúp
trẻ em được an toàn, như là việc huấn luyện
dành cho hàng giáo sĩ, các nhân viên và các
người thiện nguyện; việc điều tra lai lịch
của họ; việc họ phải báo cáo cho giới hữu
trách khi nghi ngờ có sự lạm dụng; việc
cộng tác với các cơ quan tiểu bang, v.v.
Chúng tôi tiếp tục ủng hộ các biện pháp
nhằm giúp mang lại một môi trường an
toàn cho trẻ em. Tuy nhiên, dự luật SB360
không phải là một biện pháp có hiệu quả;
đó là vì những ai phạm tội ác lạm dụng trẻ

ngưỡng của chúng ta.
Ngay cả khi dự luật bao gồm những thay

thế, đã giữ thế quyền và thần quyền tách
biệt trong phạm vị này. Trong hơn 200
năm, luật lệ Hoa Kỳ đã tôn trọng sự bất
khả xâm phạm của ấn toà giải tội. Chúng
ta hãy giữ sự tách biệt này.
Vì Thượng viện tiểu bang đã thông
qua dự luật này, tôi xin anh chị em giúp
tôi bày tỏ mối quan tâm đối với Hạ viện
tiểu bang. Xin lập tức liên lạc với Dân
biểu tiểu bang của anh chị em và yêu cầu
họ bỏ phiếu chống lại dự luật SB360. Anh
