families continued pursuing their claims through trials, appeals, bankruptcy proceedings, and enormous uncertainty,” Tisi said.“ Three attempts were made to resolve the litigation through bankruptcy, and each time the cases ultimately returned to the civil justice system.
“ Beyond obtaining compensation for women and their families, it provides great comfort to know that generations of women will not be exposed and will not get cancer,” Tisi added.“ There are women who will be alive in the future because of this case.”
Tisi, along with Levin Papantonio attorneys Cameron Stephenson and Sara Papantonio, served on the trial team that obtained a $ 20 million Florida verdict in October 2025 for the family of Dr. Alberto A. Casaretto in a talc mesothelioma case.
What The Settlement Changes Unlike the attempted bankruptcy resolutions, the new agreement is voluntary. It does not bind people who reject its terms, nor does it resolve potential future claims by individuals who develop ovarian cancer later. It also does not depend upon bankruptcy court approval.
The payment timetable is markedly different as well. Reuters reported that qualifying claims are expected to be paid in full in less than two years, compared with a proposed bankruptcy structure that could have extended payments for
decades. Johnson & Johnson expects to make as much as $ 3 billion in payments in 2027, with additional payments beginning in 2028.
For plaintiffs’ attorneys, however, the announcement is not the end of the process. Claimants must evaluate the settlement, enrollment and participation requirements must be satisfied, individual claims must be evaluated under the compensation structure, and the 95 percent threshold must ultimately be reached.
“ A $ 5.5 billion announcement makes the headline, but for our clients the important question is what happens next,” Tisi said.“ This is about turning a decade of litigation into an actual path to compensation.
“ Attorneys now have an obligation to help clients understand how the settlement works, how their individual claims will be evaluated, what choices they have, and what deadlines apply,” Tisi continued.“ Until the enrollment process is completed and compensation reaches the people whose lives have been affected, our work is not finished.”
As Levin Papantonio said in its announcement of the settlement, the agreement is only the first step. For plaintiffs and their lawyers, the next chapter will be measured not by the settlement announced, but by the claims resolved and the compensation ultimately delivered.
