municipal , special , or labor attorney , police director , appropriate authority , etc ., cannot investigate the Chief or Head of Internal Affairs .
Lastly , while the County Prosecutor or Attorney General is responsible for conducting the internal affairs investigation , neither entity has the authority to discipline . Hence , once the investigation is completed , the County Prosecutor or Attorney General must turn their findings , which could include “ a non-binding recommendation ,” over to the appropriate authority [ or Chief if Head of Internal Affairs ] ( i . e ., employer ) to “ make the final decision regarding discipline ” (§ 5.1.8 ).
