considered too indefinite to enable the
parties in trust to carry it out. It was
also considered by the court below, we
believe, that the commissioners of the
county could not accept such a trust.
The Supreme Court, as reported last
week, has overruled the decision if the
Circuit Court and the will can now be
enforced.
In the same issue, the LaGrange
Standard published this copy of Rogers’ will.
I, David Rogers of Clear Spring
Township in the county of LaGrange in
the State of Indiana, do make to publish
this, my last will and testament in names
following to wit:
I give and devise all my real estate
lying in said county of LaGrange to The
commissioners of the county of LaGrange
aforesaid and their successors in office
forever in trust, however, for the uses &
purpose herein after expressed to will:
In trust & for the use & benefit of the
orphan poor and for other destitute persons of said county: & dissolve that said
commissioners & their successors to claim
said lands & so improve and use the same
as shall best secure the benefits of a home
thereon & a support and education therefrom for said poor and destitute persons.
Secondly, I give, devise and bequeath
all my other property of every description
to said commissioners & their successors
in office forever in trust, to be converted
into money and used & invested as they,
said commissioners, shall think most
conducive to aid in the improvement of
the lands first hereinbefore mentioned &
in the support and education of said poor
and destitute person. It is my will that the
lands first hereinbefore mentioned shall
be forever retained by said commissioner
& their successors for the purpose aforesaid & that no portion these of be sold or
transferred but that the same shall be forever kept and known as the David Rogers
Home for the support and education of the
orphan poor of LaGrange County Indiana.
I hereby appoint Dresdon W.H.
Howard of Wauseon Fulton County Ohio
& Erastus Nelson of Clearspring township
of LaGrange County Indiana, executors of
this my last will & I direct that after my
just debts & funeral expenses are paid,
