Planning board approves 13th Street subdivision
PLANNING , from Page 1 Michael Delfiandra , were seeking to subdivide a 3.2-acre lot from an adjacent , 9.78 conforming lot within the rr zone . During the October 18 meeting , board engineer robert Vettese , of adams , rehmann and Heggan ( arH ) associates , said the town was seeking two easements pertaining to a sanitary sewer hookup and storm water drainage for the subdivision , which the applicant was not ready to grant at the time .
Since then , Vettese said he spoke with the applicant , the applicant ’ s engineer , town solicitor Michael Malinsky and board solicitor James Schroeder and decided to withdraw the easement requests .
“ What we ’ re looking at is 99 percent of the cases we ask for an easement , it ’ s usually granted . in this particular case , we really cannot force them to grant an easement to the town of Hammonton on either case , whether it be the drainage or the sanitary sewer , so we ’ re relinquishing that request ,” Vettese said . instead , the application will be subject to the applicant getting the lot numbers approved by the tax assessor and the board making a recommendation for a waiver of curb and sidewalk , which there is none of in the area in question , according to board member Joseph Giralo . a motion to approve the minor subdivision in accordance to the aforementioned conditions was made by Giralo , seconded by board member Linda Byrnes and passed unanimously . the board also made a motion to adopt a resolution to immediately memorialize the application so the applicant can report to the Pinelands Commission for further processing . a motion to approve the resolution (# 11- 2017 ) was made by Giralo , seconded by Byrnes and passed unanimously . although the approval grants the applicant a curb and sidewalk waiver , they will not be relieved from entering an agreement with the town in the future if necessary , according to Schroeder . in other news , board chairman edward Marinelli said the town code enforcement official has issued a certified letter to parties responsible for a retention basin on the White Horse Pike between Burger King and applebee ’ s , which is unkempt , littered and not securely enclosed , according to Marinelli . Marinelli said he will put the matter on the agenda for the board ’ s next meeting and will continue to follow up on it . Marinelli also addressed the conditions of an automotive repair shop on Plymouth road that is owned by Michael Weiss . Marinelli said the owner ’ s lot is overloaded with vehicles even though Weiss already appeared before the board and agreed on various conditions for his business .
“ it ’ s out of hand there like it was when he was before the board ,” Marinelli said .
Like the basin on the White Horse Pike , Marinelli said the board will follow up on the concerns with Weiss at the next meeting and will cite the resolution previously approved for Weiss to confirm whether or not any conditions of approval are being violated .
